TITLE:            CONCERNING NEGATIVE LICENSING ACTION AGAINST AN AFFILIATE OF A CHILD CARE LICENSEE AS A STANDARD FOR THE LICENSURE OF CHILD CARE FACILITIES.



Summary of Assessment


            The bill includes within the standards established by the State Board of Human Services for licensing child care facilities, whether an "affiliate of the licensee" has ever had a child care license denied, suspended, or revoked, and defines the term as follows:

 

               any person or entity owning more than 5 percent of the ownership interest in the business operated by the licensee or the applicant for a license; and

               any person directly responsible for the care and welfare of children served.


            Additionally, the bill defines "certification", "negative licensing action", and "final agency action". The bill is effective upon signature of the Governor.


            The bill is assessed as having no fiscal impact. The bill amends/adds definitions to the child care licensing statutes.
