Local Government Impact: The bill may affect local government revenue and expenditures if current local firearm laws are stricter, or impose greater penalties, than state law.



Summary of Legislation


            This bill revises state criminal codes by prohibiting any municipality, county, or city and county from adopting any ordinance or resolution that would impose a greater restriction on a person's ability to own, possess, carry, use, or transfer a firearm than is imposed by state law. The bill specifies that any ordinance or resolution that imposes a greater penalty than would be imposed by state law is considered a greater restriction. Any ordinance or resolution passed prior to the effective date of this bill will be deemed unauthorized and unenforceable. The bill changes the affirmative defenses to the charges of carrying concealed weapons to exceptions to the law.





Local Government Impact


            This bill may affect local government revenue if a local government ordinance or resolution regarding firearms imposes a penalty greater than state law. The bill will reduce, or eliminate, any fines for violations of firearms ordinances where the fine is greater than that imposed by state law. The amount of these fine revenue reductions, if any, has not been estimated.


            The bill may also require local governments to incur expenses to replace ordinances or resolutions that may become ineffective. The amount of these expenses, if any, have not been estimated.
