Local Government Impact: Potential increased costs to counties to review, provide input, and, when appropriate, make recommendations on site-specific classifications and standards for ground water located within the county.



Summary of Legislation


            The bill requires the Water Quality Control Commission (WQCC), Department of Public Health and Environment, to give substantial deference to the recommendations of a Board of County Commissioners (BOCC) arising from a request from a county resident for adoption of site-specific classification and water quality standards for ground water.: If a county resident requests the BOCC to review the proposal, and the BOCC makes recommendations that are more protective of water quality standards, the WQCC is required to give the recommendations substantial deference. The bill will not have a fiscal impact on any state agency. The bill will, however, have a conditional fiscal impact on some counties that are requested to review proposals and make recommendations.




Local Government Impact


            The bill requires BOCCs to review proposals for site-specific classification and water quality standards for ground water, if requested by a resident of the county. In addition to reviewing the proposals, a BOCC would be required gather whatever data it deems necessary, including but not limited to, holding public meetings. The BOCC may, after review and investigation of such proposal make recommendations to the WQCC. The impact to a BOCC is conditional on whether county citizens request review of a proposal and the BOCC's need to gather relevant data. The potential costs to counties has not been estimated.
