TITLE:            CONCERNING AN EXCEPTION TO THE FIVE-YEAR LIMITATION ON MEDICAL TREATMENT IN THE AUTOMOBILE NO-FAULT LAWS.



Summary of Assessment


            This bill creates an exception to the 5-year limitation period on medical treatment in the automobile no-fault law: the exception allows a patient who is less than 13 years of age at the time of the accident, and surgery cannot be performed because of the patient's lack of physical maturity, to be provided reasonable and necessary surgical or reconstructive procedures beyond the 5-year limitation. The bill would become effective 90 days after the Legislature adjourns unless a referendum petition is filed and approved by the voters. The provisions of the bill will apply to claims arising out of motor vehicle accidents occurring on or after January 1, 2000.


            The provisions of the bill will affect insurers and their insureds. It will not have a fiscal impact the Division of Insurance, Department of Regulatory Agencies, or any other state agency or unit of local government. Therefore, this bill is assessed as having no fiscal impact.
