TITLE:            CONCERNING ISSUANCE OF CIVIL RESTRAINING ORDERS.

Summary of Assessment

            The bill includes a number of provisions regarding civil restraining orders. Most notably, it consolidates the various types of civil restraining orders issued by a municipal, county, or district court into a single type of civil restraining order, and makes an exception to restraining orders issued in domestic relations cases and emergency protection orders to prevent domestic abuse. The bill specifies the procedures a court must use in issuing a civil restraining order. The bill includes an effective date of July 1, 1999, and shall apply to civil restraining orders issued on or after that date.

            The Judicial Department indicates that this bill will not impact the courts' workload. Therefore, the bill is assessed as having no fiscal impact.
