Summary of Legislation
The bill (as amended by the Senate Judiciary Committee, April 22, 1999) extends, until January 1, 2007, the voluntary contribution tax check-off for Colorado taxpayers to designate an amount they wish to contribute to the Colorado Domestic Abuse Program Fund.
The bill as amended, eliminates the newspaper publication requirements when a person changes their name if the person: (1) is a victim of a crime, the underlying factual basis of which has been found by the court on the record to include an act of domestic violence; (2) is the victim of child abuse; or (3) is the victim of domestic abuse.
The bill also allows for the Colorado Domestic Abuse Program Fund, created under Section 39-22-802, C.R.S., to be funded by any grants or donations or General Fund appropriations and gives authority to the Executive Director of the Department of Human Services to expend these moneys.
State Expenditures
The bill extends the domestic violence check-off for seven years through January 1, 2007. Since the Department of Revenue already administers this check-off, there would be no change in income tax forms and no fiscal impact for this provision of the bill.
Since the cost of publication in a newspaper regarding a name change is the responsibility of the person filing for the change, this provision of the bill does not have fiscal impact.
The bill also expresses legislative intent for a future appropriation of $100,000 General Fund to the Department of Human Services for allocation to the Colorado Domestic Abuse Program Fund in FY 2000-01.
Local Government Impact
The amended bill will not have a fiscal impact on any unit of local government.

As indicated above, the bill also expresses legislative intent for a future appropriation of $100,000 General Fund to the Department of Human Services for allocation to the Colorado Domestic Abuse Program Fund in FY 2000-01 contingent on passage of HB 99-1168 and sufficient General Fund savings generated by the bill.
