TITLE:            CONCERNING IMMUNITY FROM CIVIL LIABILITY FOR AN EMPLOYER WHO PROVIDES INFORMATION ABOUT AN EMPLOYEE TO SUCH EMPLOYEE'S PROSPECTIVE EMPLOYER.



Summary of Assessment


            The bill provides immunity from civil liability to employers, and their authorized employees, who disclose information about a current or former employee's job history or job performance to prospective employers. Immunity would not apply if the information was false or the employer providing the information knew or reasonably should have known that the information was false. The bill requires an employer that provides written information to a prospective employer about a current or a former employee to send a copy of the information to the last-known address of the person who is the subject of the written information. The bill would become effective upon signature of the Governor.


            The provisions of the bill would result in the elimination of a minimal number of cases that are filed in the courts. The provisions would not impact any other agency of the state, or unit of local government. Therefore, this bill is assessed as having no fiscal impact.
