TITLE:            CONCERNING THE GRANTING OF IMMUNITY TO LICENSED PHYSICIANS FROM CIVIL LIABILITY WHILE PERFORMING VOLUNTEER WORK.



Summary of Assessment


            This bill gives a licensed physician immunity from civil liability for any act or omission while performing volunteer work, so long as the act or omission was not grossly negligent or willful and wanton misconduct. The immunity would apply only to licensed physicians, who practice medicine as a volunteer for a nonprofit organization, nonprofit corporation, or hospital, without compensation, other than reimbursement for actual expenses. The bill would become effective September 1, 1999, unless a referendum petition is filed and approved by the voters.


            The provision of immunity from civil liability in such cases would not have a significant impact on the courts, or any impact on any other agency of the state, or unit of local government. Therefore, this bill is assessed as having no fiscal impact.
