TITLE:            CONCERNING A PROHIBITION ON OVERTAKING ANOTHER MOTOR VEHICLE WHILE IN A SCHOOL ZONE.

Summary of Assessment

The bill would make it a Class A traffic infraction to pass a vehicle moving in the same direction while a driver is in a designated school zone. The bill would become effective upon the Governor’s signature.

The number of times that the Colorado State Patrol or a county sheriff would issue a citation under this provision would be minimal. The amount of Highway User Tax Fund fine revenue collected from citations issued by the Colorado State Patrol or a county sheriff imposed under this bill would be insignificant. It is estimated that most citations under this provision would be issued by local law enforcement entities and the revenue collected from fines would be minimal to any jurisdiction. Therefore, this bill is assessed as having no fiscal impact to state or local governments.
