Business After consideration on the merits, the committee recommends that SB 98-43 be

Affairs amended as follows and, as so amended, be referred to the Committee of the Whole with

Amend printed bill, page 1, line 7, after "GAUGE", insert "OR STANDARD GAUGE".

Strike pages 2 and 3 and substitute the following:

"SECTION 2.  40­3­101, Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW SUBSECTION to read:

40­3­101.  Reasonable charges ­ adequate service. (3)  NOTHING IN THIS ARTICLE SHALL BE DEEMED TO APPLY TO A SCENIC RAILROAD.

SECTION 3.  Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.".
