FIRST REPORT OF FIRST CONFERENCE COMMITTEE

THIS REPORT AMENDS THE

REREVISED BILL

To the President of the Senate and the

Speaker of the House of Representatives:

Your first conference committee appointed on HB 98­1062, concerning procedural requirements for the selection of an independent medical examiner in cases of disputes under the "Workers' Compensation Act of Colorado", has met and reports that it has agreed upon the following:

1. That the House accede to the Senate amendments made to the bill, as said amendments appear in the rerevised bill.

2. That, under the authority granted the committee to consider matters not at issue between the two houses, the following amendment be recommended:

Amend rerevised bill, page 1, line 5, strike "time. (1)" and substitute "time ­ repeal. (1) (a)";

after line 7, insert the following:

"(b) (I)  THE TIME LIMITS SET FORTH IN THIS SECTION SHALL TAKE EFFECT JANUARY 1, 1999. COMMENCING JULY 1, 1998, EVERY INSURER OR SELF­INSURED EMPLOYER WHO HAS RECEIVED NOTICE OF A LOST­TIME INJURY FOR WHICH THE INSURER OR SELF­INSURED EMPLOYER IS OR MAY BE LIABLE, AND EVERY ATTORNEY REPRESENTING A CLAIMANT WHO HAS SUFFERED A LOST­TIME INJURY, SHALL INFORM THE CLAIMANT OF THE FACT THAT THE TIME LIMITS SET FORTH IN THIS SECTION SHALL APPLY TO THE CLAIMANT'S CASE AS OF JANUARY 1, 1999. ALL CLAIMANTS WHO HAVE SUFFERED A LOST­TIME INJURY ON OR BEFORE JANUARY 1, 1999, INCLUDING THOSE WHO SUFFERED SUCH INJURY BEFORE JULY 1, 1998, SHALL BE INFORMED IN ACCORDANCE WITH THIS PARAGRAPH (b).

(II)  THIS PARAGRAPH (b) IS REPEALED, EFFECTIVE JULY 1, 1999.".

NOTWITHSTANDING SECTION 25­7­133, SUCH REVISIONS SHALL BE SUBMITTED TO THE FEDERAL ENVIRONMENTAL PROTECTION AGENCY FOR INCORPORATION INTO THE STATE IMPLEMENTATION PLAN AS EXPEDITIOUSLY AS POSSIBLE AND SHALL NOT BE SUBJECT TO FURTHER REVIEW AND APPROVAL PURSUANT TO SECTION 25­7­133.".

(2.5) NOTWITHSTANDING THE PROVISIONS OF SUBSECTION (2) OF THIS SECTION, IN THE CASE OF ANY VIOLATION OF SECTION 6­1­105 (1) (qq), IN ADDITION TO INTEREST, COSTS OF THE ACTION, AND REASONABLE ATTORNEY FEES AS DETERMINED BY THE COURT, THE PREVAILING PARTY SHALL BE ENTITLED ONLY TO DAMAGES IN AN AMOUNT SUFFICIENT TO REFUND MONEYS ACTUALLY PAID FOR A MANUFACTURED HOME NOT DELIVERED IN ACCORDANCE WITH THE PROVISIONS OF SECTION 6­1­105 (1) (qq).".
