A BILL FOR AN ACT

CONCERNING THE EXPANSION OF COUNTY POWERS TO INCLUDE THE REGULATION OF THE PURCHASE OF TOBACCO BY MINORS.

Authorizes any county or city and county to prohibit the sale of cigarettes or tobacco products to minors and to enact requirements for the sale of cigarettes or tobacco products stricter than those imposed by the general assembly.


Be it enacted by the General Assembly of the State of Colorado:

SECTION 1.  18­13­121 (3), Colorado Revised Statutes, is amended to read:

18­13­121.  Furnishing cigarettes or tobacco products to minors ­ sale of cigarettes or tobacco products in vending machines prohibited ­ warning sign. (3)  Nothing in this section shall be construed to prohibit any COUNTY, CITY AND COUNTY, OR statutory or home­rule municipality from enacting an A RESOLUTION OR ordinance which THAT prohibits a person under eighteen years of age from purchasing any cigarettes or tobacco products, as defined in section 39­28.5­101 (5), C.R.S., WITHIN ITS JURISDICTION, or imposes requirements more stringent than THOSE provided in this section.

SECTION 2.  30­15­401, Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW SUBSECTION to read:

30­15­401.  General regulations. (1.5)  IN ADDITION TO ANY OTHER POWER, THE BOARD OF COUNTY COMMISSIONERS HAS THE POWER TO ADOPT A RESOLUTION OR ORDINANCE CONCERNING THE SALE OF CIGARETTES OR TOBACCO PRODUCTS TO MINORS AS PROVIDED IN SECTION 18­13­121 (3), C.R.S.

SECTION 3.  Effective date. This act shall take effect at 12:01 a.m. on the day following the expiration of the ninety­day period after final adjournment of the general assembly that is allowed for submitting a referendum petition pursuant to article V, section 1 (3) of the state constitution; except that, if a referendum petition is filed against this act or an item, section, or part of this act within such period, then the act, item, section, or part, if approved by the people, shall take effect on the date of the official declaration of the vote thereon by proclamation of the governor.
