"SECTION 24. 22­33­205 (1), Colorado Revised Statutes, as amended by Senate Bill 98­1, enacted at the Second Regular Session of the Sixty­first General Assembly, is amended to read:

22­33­205.  Services for expelled students ­ grants ­ criteria.  (1) (a) There is hereby established in the department of education the expelled student services grant program, referred to in this section as the "program". The program shall provide grants to school districts and to pilot schools established pursuant to article 38 of this title to assist them in providing educational services to expelled students pursuant to section 22­33­203 (2) and to students at risk of expulsion. Any school district that provides educational services within the school district pursuant to section 22­33­203 (2) and any pilot school that provides educational services pursuant to an agreement entered into pursuant to section 22­33­203 (2) is eligible to participate in the grant program.

(b)  IN ADDITION TO SCHOOL DISTRICTS AND PILOT SCHOOLS, THE DEPARTMENT OF MILITARY AFFAIRS MAY APPLY FOR A GRANT PURSUANT TO THE PROVISIONS OF THIS SECTION TO ASSIST THE DEPARTMENT WITH A PROGRAM TO PROVIDE EDUCATIONAL SERVICES TO EXPELLED STUDENTS. THE DEPARTMENT SHALL FOLLOW APPLICATION PROCEDURES ESTABLISHED BY THE DEPARTMENT OF EDUCATION PURSUANT TO SUBSECTION (2) OF THIS SECTION. THE DEPARTMENT OF EDUCATION SHALL DETERMINE WHETHER TO AWARD A GRANT TO THE DEPARTMENT OF MILITARY AFFAIRS AND THE AMOUNT OF THE GRANT.

(c)  Grants awarded pursuant to this section shall be paid for out of any general fund moneys appropriated to the department of education for implementation of the program.".

(a)  The general fund appropriation for public school finance, total program, is decreased by three million three hundred ninety­one thousand one hundred twenty dollars ($3,391,120).

(b)  The general fund appropriation for distributions, special contingency reserve, is decreased by five hundred thousand dollars ($500,000).

(2)  In addition to any other appropriation, there is hereby appropriated, out of any moneys in the general fund not otherwise appropriated, to the state public school fund created in section 22­54­114, Colorado Revised Statutes, for the fiscal year beginning July 1, 1997, the sum of three million eight hundred ninety­one thousand one hundred twenty dollars ($3,891,120).

SECTION 26. Appropriations ­ adjustments in 1998 long bill.

(1)  For the implementation of this act, appropriations made in the annual general appropriation act for the fiscal year beginning July 1, 1998, shall be adjusted as follows:

(a)  The appropriation made to the department of education, public school finance, total program, is increased by three million seven thousand two hundred six dollars ($3,007,206). Said sum shall be cash funds exempt from the state public school fund created in section 22­54­114, Colorado Revised Statutes.

(b)  The appropriation made to the department of education, public school finance, special education ­ gifted and talented children, is increased by five hundred thousand dollars ($500,000). Said sum shall be cash funds exempt from the state public school fund created in section 22­54­114, Colorado Revised Statutes.

(c)  The appropriation made to the department of education, expelled student services, is increased by five hundred thousand dollars ($500,000). Said sum shall be cash funds exempt from the state public school fund created in section 22­54­114, Colorado Revised Statutes.

(2)  In addition to any other appropriation, there is hereby appropriated, out of any moneys in the state public school fund created in section 22­54­114, Colorado Revised Statutes, not otherwise appropriated, to the department of education, for the fiscal year beginning July 1, 1998, the sum of three million nine hundred sixty­seven thousand two hundred six dollars ($3,967,206), or so much thereof as may be necessary, for funding the Colorado student assessment program pursuant to article 7 of title 22, Colorado Revised Statutes; except that this amount shall be decreased by one million five hundred seventeen thousand two hundred six dollars ($1,517,206) if H.B. 98­1267, enacted at the Second Regular Session of the Sixty­first General Assembly, does not become law. Said sum shall be cash funds exempt.

(3)  In addition to any other appropriation, there is hereby appropriated, out of any moneys in the state public school fund created in section 22­54­114, Colorado Revised Statutes, not otherwise appropriated, to the department of education, for the fiscal year beginning July 1, 1998, the sum of eight hundred thousand dollars ($800,000), or so much thereof as may be necessary, for the implementation of section 22­54­122, Colorado Revised Statutes. Said sum shall be cash funds exempt.

SECTION 27. Department of military affairs ­ educational services for expelled students ­ request for supplemental appropriation ­ federal funds. (1)  If the department of military affairs receives a grant from the department of education pursuant to section 22­33­205, Colorado Revised Statutes, from moneys appropriated to the department of education for expelled student services or receives payments from school districts under agreements entered into between school districts and the department pursuant to section 22­33­204, Colorado Revised Statutes, for the provision of educational services to expelled students, the department shall seek a supplemental appropriation for the 1998­99 fiscal year to authorize the department to expend any moneys received. Until a supplemental appropriation request can be made, the department may seek approval for the overexpenditure of its appropriation for the 1998­99 fiscal year in accordance with the provisions of section 24­75­111, Colorado Revised Statutes.

(2)  Any moneys received by the department of military affairs may be used by the department to provide educational services to expelled students through the establishment of the national guard challenge program in the state of Colorado and to apply for federal funds that are available to the state of Colorado to establish such a program. If federal funds are applied for and received by the state of Colorado to establish such a program during the fiscal year beginning July 1, 1998, the department of military affairs shall have the authority to spend the total amount of federal funds received for the implementation of the program. The amount of federal funds anticipated to be received by the state of Colorado is two million one hundred thousand dollars ($2,100,000).".

INTRODUCTION AND CONSIDERATION OF RESOLUTION

The following resolution was read by title and given immediate consideration:

HR98-1010 by Representatives Anderson and Tucker--Concerning the House Committee on ethics.

Be It Resolved by the House of Representatives of the Sixty­first General Assembly of the State of Colorado:

That Rule No. 49 of the Rules of the House of Representatives is amended to read:

49. COMMITTEE ON ETHICS

(a) The Speaker shall receive written, signed complaints from Any person WHO HAS KNOWLEDGE concerning misconduct involving legislative duties by a member of the House, including but not limited to the alleged violation of the Rules of the House of Representatives or of section 40 of article V of the state constitution, MAY FILE A WRITTEN, SIGNED COMPLAINT WITH THE SPEAKER SETTING FORTH THE FACTS THAT CONSTITUTE THE ALLEGED MISCONDUCT AND SPECIFYING THE STATUTES, RULES, CONSTITUTIONAL PROVISIONS, OR OTHER ETHICAL PRINCIPLES ALLEGED TO HAVE BEEN VIOLATED. THE SPEAKER SHALL PROVIDE THE MEMBER COMPLAINED AGAINST WITH A COPY OF THE COMPLAINT. THE SPEAKER SHALL CONSULT WITH THE MAJORITY LEADER AND THE MINORITY LEADER ABOUT THE COMPLAINT. IF AT LEAST TWO OF THE THREE LEADERS CONCLUDE THAT THE COMPLAINT DOES NOT STATE AN ETHICAL VIOLATION, THE COMPLAINT SHALL BE DISMISSED, AND THE COMPLAINANT AND THE MEMBER COMPLAINED AGAINST SHALL BE SO NOTIFIED.

(b) Whenever such a complaint is received, IF THE COMPLAINT IS NOT DISMISSED PURSUANT TO SUBSECTION (a) OF THIS RULE, the Speaker shall appoint a committee on ethics, which shall consist of not less than five nor more than seven members. The party representation on the committee shall be in proportion generally to the relative number of members of the two major political parties in the House. The majority party members of the committee shall be selected from among the chairmen of committees of reference of the House. The minority party members of the committee shall be selected, after considering recommendations by the minority leader, from among the members of the House who are senior in service and experience. The Speaker shall designate the chairman and vice­chairman of the committee from among its members.

(b) (c) The committee shall notify the person against whom the complaint was brought and shall provide such person with a copy of the complaint. The person complained against may submit a written answer to the committee WITHIN TEN DAYS AFTER APPOINTMENT OF THE COMMITTEE. The committee shall make a preliminary investigation of the complaint. THE PRELIMINARY INVESTIGATION SHALL CONSIST OF AN EXAMINATION OF THE COMPLAINT, THE ANSWER, IF ANY, AND ANY OTHER EVIDENCE COMPILED PURSUANT TO REQUEST OF THE COMMITTEE, BUT THE COMMITTEE SHALL NOT RECEIVE TESTIMONY OR OTHER EVIDENCE FROM OTHER SOURCES. THE PRELIMINARY INVESTIGATION SHALL BE COMPLETED WITHIN THIRTY DAYS AFTER APPOINTMENT OF THE COMMITTEE. If, after THE PRELIMINARY investigation, it THE COMMITTEE determines no violation has occurred, the complaint shall be dismissed.

(d) If, after THE PRELIMINARY investigation, it THE COMMITTEE determines probable cause exists TO FIND that a violation may have occurred, it shall so notify the person complained against. WITHIN SEVEN DAYS AFTER SUCH NOTIFICATION, such person may request a hearing before the committee, at which he OR SHE shall be entitled to appear, present evidence, cross­examine witnesses, and be represented by counsel. The committee shall have the power to take testimony under oath and to issue subpoenas and subpoenas duces tecum in the manner provided by Joint Rule No. 33 (b), (c), and (d) of the Joint Rules of the Senate and House of Representatives. THE HEARING SHALL COMMENCE WITHIN FOURTEEN DAYS AFTER RECEIPT OF THE REQUEST FOR A HEARING.

(c) (e) All proceedings of the committee shall be governed by the provisions of part 4 of article 6 and part 2 of article 72 of title 24, Colorado Revised Statutes.

(d) (f) AFTER A HEARING HELD PURSUANT TO SUBSECTION (d) OF THIS RULE, the committee may DISMISS THE COMPLAINT, OR, IF IT FINDS THAT ACTION SHOULD BE TAKEN AGAINST THE MEMBER COMPLAINED AGAINST, IT SHALL make appropriate recommendations to the House of Representatives, based upon the investigations conducted and hearings held pursuant to this rule. In the case of a member of the House, the committee may recommend dismissal of the charges, INCLUDING reprimand, censure, or expulsion. Expulsion of a House member shall require the affirmative vote of two­thirds of the members elected to the House. Reprimand or censure of a member shall require the affirmative vote of a majority of the members elected to the House.

(g) Action of the LEADERSHIP, THE ETHICS COMMITTEE, OR THE House pursuant to this rule is final and not subject to court review. NOTHING IN THIS RULE SHALL PROHIBIT THE HOUSE OF REPRESENTATIVES FROM TAKING ANY ACTION BASED UPON ITS AUTHORITY TO JUDGE THE QUALIFICATIONS OF ITS MEMBERS PURSUANT TO SECTION 10 OF ARTICLE V OF THE STATE CONSTITUTION.

(e) (h) The committee may retain such counsel and may hire such investigators as it deems necessary for the performance of its duties under this rule. All expenditures incurred pursuant to this subsection (e) SUBSECTION (h) shall be approved by the Speaker and paid by vouchers and warrants drawn as provided by law from appropriations made to the General Assembly.

(f) (i) The committee may adopt rules of procedure for the orderly conduct of its meetings, investigations, and hearings, which rules shall be consistent with this rule and other applicable rules and statutes.

(g) (j) If the written signed complaint concerns misconduct of the Speaker, then the duties of the Speaker in this rule shall be the duties of the majority floor leader AND THE DUTIES OF THE MAJORITY FLOOR LEADER SHALL BE THE DUTIES OF THE ASSISTANT MAJORITY LEADER. IF THE COMPLAINT CONCERNS MISCONDUCT OF THE MAJORITY FLOOR LEADER OR THE MINORITY LEADER, THEN THE DUTIES OF SUCH LEADER IN THIS RULE SHALL BE THE DUTIES OF THE ASSISTANT MAJORITY LEADER OR THE ASSISTANT MINORITY LEADER, AS THE CASE MAY BE.

SECTION 130.  42­3­134 (26) (a), Colorado Revised Statutes, is amended to read:

42­3­134.  Registration fees ­ passenger and passenger­mile taxes. (26) (a) (I)  Effective July 1, 1986, in addition to any other fee imposed by this section, there shall be collected, at the time of registration, a fee of fifty cents on every item of class A, B, or C personal property required to be registered pursuant to this article. Such fee shall be transmitted to the state treasurer, who shall credit the same to a special account within the highway users tax fund, to be known as the AIR account, and such moneys shall be used, subject to appropriation by the general assembly, to cover the direct costs of the motor vehicle emissions activities of the department of public health and environment in the presently defined nonattainment area, and to pay for the costs of the commission in performing its duties under sections 25­7­106.1, 25­7­106.3, and 25­7­106.5, C.R.S. In the program areas within counties affected by this article, the county clerk and recorder shall impose and retain an additional fee of up to seventy cents on every such registration to cover reasonable costs of administration of the emissions compliance aspect of vehicle registration. The department of public health and environment is hereby authorized to accept and expend grants, gifts, and moneys from any source for the purpose of implementing its duties and functions under this section or sections 25­7­106.1, 25­7­106.3, and 25­7­106.5, C.R.S.

(II)  NOTWITHSTANDING ANY PROVISION OF SUBPARAGRAPH (I) OF THIS PARAGRAPH (a) TO THE CONTRARY, ON JULY 1, 1998, THE STATE TREASURER SHALL DEDUCT FIVE HUNDRED THOUSAND DOLLARS FROM THE AIR ACCOUNT AND TRANSFER SUCH SUM TO THE ENVIRONMENTAL LEADERSHIP POLLUTION PREVENTION REVOLVING FUND, CREATED IN SECTION 25­6.7­109 (2), C.R.S.

SECTION 131.  Repeal. 24­21­104 (3) (d) (IV), as enacted by Senate Bill 98­152, enacted at the Second Regular Session of the Sixty­first General Assembly, is repealed as follows:

FIRST REPORT OF FIRST CONFERENCE COMMITTEE

on HB98-1266

This Report Amends the Rerevised Bill.

To the President of the Senate and the

Speaker of the House of Representatives:

Your first conference committee appointed on HB 98­1266, concerning an exclusion of certain income from Colorado taxable income, and, in connection therewith, excluding certain interest income, dividend income, and net capital gains from the income tax imposed on individuals, estates, and trusts, has met and reports that it has agreed upon the following:

1. That the House accede to the Senate amendments made to the bill, as said amendments appear in the rerevised bill.

2. That, under the authority granted the committee to consider matters not at issue between the two houses, the following amendment be recommended:

Amend rerevised bill, page 1, line 8, strike "1999," and substitute "1998,".

The following prayer was read by Representative Pankey and was ordered printed in the Journal:

Quoting "The Farewell Address of President George Washington, September 17, 1796."

Of all the dispositions and habits, which lead to political prosperity, Religion and Morality are indispensable supports. In vain would that man claim the tribute of Patriotism, who should labor to subvert these great pillars of human happiness, these firmest props of the duties of Men and Citizens. The mere Politician, equally with the pious man, ought to respect and to cherish them. A volume could not trace all their connexions sic with private and public felicity. Let it simply be asked, Where is the security for property, for reputation, for life, if the sense of religious obligation desert the oaths, which are the instruments of investigation in Courts of Justice? And let us with caution indulge the supposition, that morality can be maintained without religion. Whatever may be conceded to the influence of refined education on minds of peculiar structure, reason and experience both forbid us to expect, that national morality can prevail in exclusion of religious principle.

It is substantially true, that virtue or morality is a necessary spring of popular government. The rule, indeed, extends with more or less force to every species of free government. Who, that is a sincere friend to it, can look with indifference upon attempts to shake the foundation of the fabric?

Though in reviewing the incidents of my administration, I am unconscious of intentional error, I am nevertheless too sensible of my defects not to think it probable that I may have committed many errors. Whatever they may be, I fervently beseech the Almighty to avert or mitigate the evils to which they may tend. I shall also carry with me the hope, that my Country will never cease to view them with indulgence and that, after forty-five years of my life dedicated to its service with an upright zeal, the faults of incompetent abilities will be consigned to oblivion, as myself must soon be to the mansions of rest.
