(b)  IS LICENSED PURSUANT TO THIS ARTICLE.

(8)  "Licensee" means a psychologist, clinical social worker, marriage and family therapist, or professional counselor licensed pursuant to the provisions of this article.";

(2)  No later than January 1, 1993, any psychotherapist THERAPIST licensed OR REGISTERED pursuant to the provisions of this article and any unlicensed psychotherapist shall record such therapist's name, current address, educational qualifications, disclosure statements, therapeutic orientation or methodology, or both, and years of experience in each specialty area with the grievance board for inclusion in the data base required by subsection (1) of this section. Psychotherapists THERAPISTS shall be required to update such information at least annually and at such other times and under such conditions as the grievance board shall prescribe by rule. and regulation. At the time of recording the information required by this section, the psychotherapist THERAPIST shall indicate whether or not the psychotherapist THERAPIST has been convicted of or entered a plea of guilty or a plea of nolo contendere to any felony or misdemeanor. Psychotherapists THERAPISTS recording the information required by this section shall be given a copy of the statutes and a copy of the state grievance board rules.".

(b)  The appropriation from the division of registrations cash fund to the department of regulatory agencies, division of registrations for operating expenses, is increased by twenty­seven thousand five hundred thirty­seven dollars ($27,537).

The state treasurer and the controller shall transfer such sum out of the general fund and into the capital construction fund as moneys become available in the general fund during the fiscal year beginning on said July 1. "SECTION 1.  42­6­137 (1), (2), and (5), Colorado Revised Statutes, are amended, and the said 42­6­137 is further amended BY THE ADDITION OF A NEW SUBSECTION, to read:

42­6­137.  Fees. (1)  Upon filing with the authorized agent any application for a certificate of title, the applicant shall pay to the agent a fee of five SIX dollars and fifty cents, which charge shall be in addition to the fees provided by law for the registration of such motor vehicle.

(2)  Upon the receipt by the authorized agent of any mortgage for filing under the provisions of section 42­6­121, the agent shall be paid such fees as are prescribed by law for the filing of like instruments in the office of the county clerk and recorder in the county or city and county wherein such mortgage is filed and shall receive, in addition thereto, a fee of five SIX dollars and fifty cents for the issuance of the certificate of title and the notation thereon of the existence of said mortgage.

(5)  For the issuance of any duplicate certificate of title, except as may be otherwise provided in this part 1, the agent shall be paid a fee of six SEVEN dollars and fifty cents, and, in all cases wherein the department assigns a new identifying number to any motor vehicle, the fee charged for such assignment shall be three dollars and fifty cents.

(7)  USING THE INCREASES IN TITLE ISSUANCE FEES THAT BECAME EFFECTIVE ON JULY 1, 1998, AN AUTHORIZED AGENT SHALL, IF POSSIBLE, PROVIDE THE FOLLOWING TITLES ON THE SAME DAY AS THE DATE OF REQUEST BY AN APPLICANT:

(a)  ON AND AFTER JULY 1, 1998, ANY TITLE ISSUED PURSUANT TO A TRANSFER OF A MOTOR VEHICLE CURRENTLY TITLED IN COLORADO;

(b)  ON AND AFTER JANUARY 1, 1999, ANY TITLE ISSUED FOR A NEW MOTOR VEHICLE UPON FILING OF A MANUFACTURER'S STATEMENT OF ORIGIN WITHOUT ANY LIENS; AND

(c)  ON AND AFTER JULY 1, 2000, ANY OTHER TITLE ISSUED BY THE AUTHORIZED AGENT.

SECTION 2.  42­6­138 (1) and (2), Colorado Revised Statutes, are amended to read:

42­6­138.  Disposition of fees. (1)  All fees received by the authorized agent under the provisions of section 42­6­137 (1) or (2), upon application being made for a certificate of title, shall be disposed of as follows: Three FOUR dollars thereof shall be retained by the authorized agent and disposition thereof made as provided by law; two dollars and fifty cents shall be credited to the special purpose account established by section 42­1­211.

(2)  All fees collected by the authorized agent under the provisions of section 42­6­137 (5) shall be disposed of as follows: For a duplicate certificate of title, five SIX dollars and fifty cents shall be retained by the authorized agent and disposition made as provided by law; and one dollar shall be credited to the special purpose account established by section 42­1­211; and, for assignment of a new identifying number to a motor vehicle, two dollars and fifty cents shall be retained by the authorized agent and disposition made as provided by law; and one dollar shall be credited to the special purpose account established by section 42­1­211. All fees collected by the department under the provisions of section 42­6­137 (5) shall be credited to such special purpose account.

Amend printed bill, page 3, after line 5, insert the following:

"SECTION 3.  Appropriation in the 1998 long bill to be adjusted. (1) For the implementation of this act, appropriations made in the annual general appropriation act to the department of revenue, special purpose, data processing services, titles, for the fiscal year beginning July 1, 1998 shall be adjusted as follows:

(a) The cash fund exempt appropriation for special purpose, data processing services, titles, is decreased by one hundred thirty thousand eight hundred seventy dollars ($130,870).

(b) The number of FTE for special purpose, data processing services, titles, is reduced by 0.6 FTE.".

SECTION 4.  Effective date ­ applicability. This act shall take effect July 1, 1998, and shall apply to title applications made on or after said date.

SECTION 5.  Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.".


HB98-1246 be amended as follows, and as so amended, be referred to the Committee of the Whole with favorable recommendation:

Amend printed bill, page 2, after line 24, insert the following:

"SECTION 2. Appropriation. In addition to any other appropriation, there is hereby appropriated, out of any moneys in the general fund not otherwise appropriated, to the department of personnel, for allocation to the division of purchasing, for the fiscal year beginning July 1, 1998, the sum of one hundred and fifty thousand dollars ($150,000), or so much thereof as may be necessary, for the implementation of this act."

Renumber succeeding section accordingly.

Page 1, line 104, strike "PERSONNEL." and substitute "PERSONNEL, AND MAKING AN APPROPRIATION IN CONNECTION THEREWITH."


HB98-1272 be amended as follows, and as so amended, be referred to the Committee of the Whole with favorable recommendation:

Amend printed bill, page 2, line 19, strike "(1.5) (b) and (1.5) (d)," and substitute "(1.5) (b), (1.5) (d), and (3) (c),"

Page 3, after line 19, insert the following:

"(3) (c) In making the probable cause determination described in paragraph (b) of this subsection (3), a peace officer shall assume that the information received from the registry created by section 18­6­803.7 is accurate. A peace officer shall enforce a valid restraining order whether or not there is a record of the restraining order in the central registry."

INTRODUCTION OF RESOLUTION

The following resolution was read by title and referred to the committee indicated:

HJR98-1017 by Representatives May and Schauer--Concerning the

reauthorization of the federal highway program.

Committee on Transportation and Energy.

WHEREAS, A safe and efficient highway system is essential to the nation's international competitiveness, key to domestic productivity, and vital to our quality of life; and

WHEREAS, Colorado has critical highway investment needs that cannot be addressed with current financial resources as exhibited by the fact that the Federal Highway Administration rates forty­six percent of nine thousand six hundred twenty­five miles of Colorado's most important roads in either poor or mediocre condition and considers twenty­one percent of Colorado's bridges to be deficient; and

WHEREAS, The current level of federal funding for the nation's highway system is inadequate to meet rehabilitation needs, maintain the safety of the traveling public, begin solving congestions and rural access problems, conduct adequate transportation research, and keep the United States competitive in a global economy; and

WHEREAS, The federal highway program is financed by dedicated user fees that are collected from motorists to improve the highway system and deposited in the federal highway trust fund; and

WHEREAS, The federal "Taxpayer Relief Act of 1997" transferred all federal motor fuel taxes into the federal highway trust fund but provided no mechanism to ensure that such funds are spent; and

WHEREAS, The 1998 congressional budget would constrain federal highway spending well below the level of tax receipts credited to the federal highway trust fund, allowing the trust fund's cash balance to grow from just over twenty­two billion dollars to more than seventy billion dollars by the year 2003; and

WHEREAS, Colorado and other states will be prohibited from obligating any federal highway funds after April 30, 1998, unless the United States Congress and the President enact new highway legislation by that date; and

WHEREAS, Without federal highway funds, many states will be forced to delay life­saving safety improvements, congestion relief projects, and other road and bridge improvements; now, therefore,

Be It Resolved by the House of Representatives of the Sixty­first General Assembly of the State of Colorado, the Senate concurring herein:

That the United States Congress should enact legislation reauthorizing the federal highway program by May 1, 1998.

Be It Further Resolved, That the reauthorization legislation should fund the federal highway program at the highest level that the revenues in the user­financed federal highway trust fund will support.

Be It Further Resolved, That copies of this Joint Resolution be sent to the United States House of Representatives, the Untied States Senate, the President of the United States, and to each member of the Colorado Congressional Delegation.
