Amend printed bill, page 4, after line 9, insert the following:

"SECTION 3.  42­4­1409 (4) (a) and (4) (b), Colorado Revised Statutes, are amended to read:

42­4­1409.  Compulsory insurance ­ penalty ­ repeal. (4) (a)  Any person who violates the provisions of subsection (1), (2), or (3) of this section commits a class 1 misdemeanor traffic offense. NOTWITHSTANDING the minimum fine imposed by section 42­4­1701 (3) (a) (II) (A), FIVE HUNDRED DOLLARS shall be THE MINIMUM mandatory FINE FOR A VIOLATION OF SUBSECTION (1), (2), OR (3) OF THIS SECTION, EXCEPT AS OTHERWISE PROVIDED IN PARAGRAPH (b) OF THIS SUBSECTION (4). and The court shall not suspend such minimum MANDATORY fine, in whole or in part, unless it is established that appropriate insurance as required under sections 10­4­705 and 10­4­716, C.R.S., has been obtained. Nothing in this paragraph (a) shall be construed to prevent the court from imposing a fine greater than the minimum mandatory fine.

(b)  Upon a second or subsequent conviction under this section within a period of two years following a prior conviction under this section, in addition to any imprisonment imposed pursuant to section 42­4­1701 (3) (a) (II) (A), the defendant shall be punished by a minimum mandatory fine of not less than two hundred SEVEN HUNDRED FIFTY dollars, and the court shall not suspend such minimum fine, in whole or in part, unless it is established that appropriate insurance as required under sections 10­4­705 and 10­4­716, C.R.S., has been obtained. Nothing in this paragraph (b) shall be construed to prevent the court from imposing a fine greater than the minimum mandatory fine.".

Amend printed bill, page 17, after line 12, insert the following:

"SECTION 28. 43­2­201.1 (1), Colorado Revised Statutes, is amended to read:

43­2­201.1. Closure of public highways extending to public lands ­ penalty. (1) Any person, other than a governing body of a municipality or county acting pursuant to part 3 of this article, who intentionally blocks, obstructs, or closes any public highway, as described in section 43­2­201, which THAT extends to any public land, including public land belonging to the federal government, thereby closing public access to public lands, without good cause therefor, commits a class 3 CLASS 1 misdemeanor and shall be punished as provided in section 18­1­106, C.R.S.".

"SECTION 2. 18­1­704.5 (2), Colorado Revised Statutes, is amended to read:

18­1­704.5. Use of deadly physical force against an intruder. (2)  Notwithstanding the provisions of section 18­1­704, any occupant of a dwelling is justified in using any degree of physical force, including deadly physical force, against another person when that other person has made an unlawful entry, WHETHER KNOWINGLY OR UNKNOWINGLY, into the dwelling and when the occupant has a reasonable belief that such other person has committed a crime in the dwelling in addition to the uninvited entry, or is committing or intends to commit a crime against a person or property in addition to the uninvited entry, and when the occupant reasonably believes that such other person might use any physical force, no matter how slight, against any occupant.".
