HJR98-1003 be amended as follows, and as so amended, be referred to the committee on Appropriations:

Amend printed resolution, page 2, after line 26, insert the following:

"(6) Appropriation.  In addition to any other appropriation, there is hereby appropriated, out of any moneys in the general fund not otherwise appropriated, to the legislative department, for the fiscal year beginning July 1, 1998, the sum of twelve thousand four hundred thirty-three dollars ($12,433) and 0.35 FTE, or so much thereof as may be necessary, for the implementation of this act. Of said sum, eight thousand seven hundred fifty-six dollars ($8,756) and 0.25 FTE, or so much thereof as may be necessary, is for allocation to the office of legislative council staff and three thousand six hundred seventy-seven dollars ($3,677) and 0.10 FTE, or so much thereof as may be necessary, is for allocation to the office of legislative legal services.".


SB98-190 be amended as follows, and as so amended, be referred to the Committee of the Whole with favorable recommendation:

Amend reengrossed bill, page 18, strike lines 16 and 17, and substitute the following:

"section, the terms "appropriate officer" AND "candidate" and "public office" shall have the meanings ascribed to them in section";

Page 31, after line 16, insert the following:

"SECTION 58.  23­7­103 (1) (a), Colorado Revised Statutes, is amended to read:

23­7­103.  Presumptions and rules for determination of status. (1)  Unless the contrary appears to the satisfaction of the registering authority of the institution at which a student is registering, it shall be presumed that:

(a)  The domicile of an unemancipated minor is that of the parent with whom he OR SHE resides or, if there is a guardian of his OR HER person, that of such guardian, but only if the court appointing such guardian (who has legal custody of the minor child as defined in section 19­1­103 (18), C.R.S. SECTION 19­1­103 (73), C.R.S.) certifies that the primary purpose of such appointment is not to qualify such unemancipated minor as a resident of this state and that his OR HER parents, if living, do not provide substantial support to the minor child;".

Renumber succeeding sections accordingly.

Page 32, after line 3, insert the following:

"SECTION 60. 26­6­108 (2) (l), Colorado Revised Statutes, is amended to read:

26­6­108. Denial of original license ­ suspension ­ revocation ­ probation ­ refusal to renew license. (2) The department may deny, suspend, revoke, or make probationary the license of any facility regulated and licensed under this part 1 should the licensee, person employed by the licensee, or person who resides with the licensee:

(l) Admit to an act of child abuse or if substantial evidence is found that the licensee, person employed by the licensee, or person who resides with the licensee in the licensed facility has committed an act of child abuse. For the purposes of this paragraph (l), "child abuse" has the same meaning as that ascribed to it in section 19­3­303 (1), C.R.S. THE TERM "ABUSE" OR "CHILD ABUSE OR NEGLECT" IN SECTION 19­1­103 (1), C.R.S.".

STATE, VETERANS AND MILITARY AFFAIRS

After consideration on the merits, the Committee recommends the following:

HB98­1419 be amended as follows, and as so amended, be referred to the Committee of the Whole with favorable recommendation:

Amend printed bill, page 15, line 26, after the period, insert "THE JANUARY 1, 1999, DEADLINE MUST BE MET IN ORDER TO ALLOW ACQUISITION OF THE ACCOUNTING SOFTWARE THROUGH THE NORMAL PROCESS AS REVIEWED BY THE JOINT BUDGET COMMITTEE.".

SB98­193 be amended as follows, and as so amended, be referred to the Committee of the Whole with favorable recommendation:

Amend reengrossed bill, page 1, after line 1, insert the following:

"SECTION 1.  1­3­102 (1), Colorado Revised Statutes, is amended to read:

1­3­102.  Precinct caucuses. (1)  Delegates to county assemblies shall be elected at precinct caucuses which may be held in a public place in or proximate to each precinct at a time and place to be fixed by the county central committee OR EXECUTIVE COMMITTEE of each political party on the first Tuesday in April in each even­numbered year, which day shall be known as "precinct caucus day".

SECTION 2.  1­4­602 (1), Colorado Revised Statutes, is amended to read:

1­4­602.  Delegates to party assemblies. (1) (a)  County assemblies shall be held not less than ten days nor more than thirty days after precinct caucuses held on the first Tuesday in April. The county central committee OR EXECUTIVE COMMITTEE shall fix the number of delegates from each precinct to participate in the county assembly pursuant to the procedure for the selection of delegates contained in the state party central committee's bylaws or rules. The persons receiving the highest number of votes at the precinct caucus shall be the delegates to the county assembly from the precinct. If two or more candidates receive an equal number of votes for the last available place in the election of delegates to county assemblies at the precinct caucuses, the delegate shall be determined by lot by the candidates. Except as provided in subsections (2) and (6) of this section, delegates to all other party assemblies shall be selected by the respective county assemblies from among the members of the county assemblies pursuant to the state party central committee's bylaws or rules.

(b)  In determining the number of delegates from precincts which have been created or split since the previous general election, the county central committee OR EXECUTIVE COMMITTEE may allocate delegates based on the number of registered voters affiliated with the political party, pursuant to the state party central committee's bylaws or rules.

"SECTION 3.  1­4­801 (2) (a), Colorado Revised Statutes, is amended to read:

1­4­801.  Designation of party candidates by petition. (2)  The signature requirements for the petition are as follows:

(a)  Every petition in the case of a candidate for any county office shall be signed by eligible electors ELIGIBLE TO VOTE resident within the county commissioner district or political subdivision for which the officer is to be elected. The petition shall require signers equal in number to twenty percent of the votes cast in the political subdivision at the primary election for the political party's candidate for the office for which the petition is being circulated or, if there was no primary election, at the last preceding general election for which there was a candidate for the office.".

Renumber succeeding sections accordingly.

"SECTION 5.  1­45­104 (13) (a) (II), Colorado Revised Statutes is amended to read:

1­45­104.  Contribution limits. (13) (a)  No professional lobbyist, volunteer lobbyist, or principal of a professional lobbyist or volunteer lobbyist shall make or promise to make a contribution to, or solicit or promise to solicit a contribution for:

(II) (A)  The governor or a candidate for governor, when the general assembly is in regular session or when any measure adopted by the general assembly in a regular session is pending before the governor for approval or disapproval; OR

(B)  THE LIEUTENANT GOVERNOR, THE SECRETARY OF STATE, THE STATE TREASURER, THE ATTORNEY GENERAL, OR A CANDIDATE FOR ANY OF SUCH OFFICES WHEN THE GENERAL ASSEMBLY IS IN REGULAR SESSION.".

Pursuant to a request from the Senate, the Speaker appointed Representatives Entz, Chairman, Spradley and Tate as House conferees to the First Conference Committee on SB98-107.

FIRST REPORT OF FIRST CONFERENCE COMMITTEE

on HB98-1188

This Report Amends the Rerevised Bill.

To the President of the Senate and the

Speaker of the House of Representatives:

Your first conference committee appointed on HB 98­1188, concerning the "Fair Campaign Practices Act", has met and reports that it has agreed upon the following:

That the House accede to the Senate amendments made to the bill, as said amendments appear in the rerevised bill, with the following changes:

Amend rerevised bill, page 2, strike lines 3 through 21.

Renumber succeeding sections accordingly.

Page 3, strike lines 12 through 26 and substitute the following:

"(III)  A PAYMENT BY A LOBBYIST OR A PRINCIPAL OF A LOBBYIST TO A POLITICAL PARTY TO PARTICIPATE IN SUCH A FUND­RAISING EVENT SHALL BE ATTRIBUTED TO THE AGGREGATE CONTRIBUTIONS OF THE LOBBYIST OR PRINCIPAL OF A LOBBYIST TO THE POLITICAL PARTY FOR PURPOSES OF SUBSECTION (4) OF THIS SECTION AND SHALL BE REPORTED AS A CONTRIBUTION TO THE POLITICAL PARTY PURSUANT TO SECTION 1­45­108; EXCEPT THAT, IF THE LOBBYIST OR PRINCIPAL OF A LOBBYIST RECEIVES A MEAL IN RETURN FOR A PORTION OF THE PAYMENT, ONLY THE AMOUNT OF THE PAYMENT IN EXCESS OF THE VALUE OF THE MEAL SHALL BE CONSIDERED A CONTRIBUTION TO THE POLITICAL PARTY. THE POLITICAL PARTY SHALL DETERMINE THE VALUE OF THE MEAL RECEIVED FOR SUCH PAYMENT, WHICH SHALL APPROXIMATE THE ACTUAL VALUE OF THE MEAL.

(IV)  A GIFT OF A MEAL DESCRIBED IN SUBPARAGRAPH (III) OF THIS PARAGRAPH (c) BY A LOBBYIST OR A PRINCIPAL OF A LOBBYIST TO AN INCUMBENT IN OR A CANDIDATE ELECTED TO ANY OFFICE DESCRIBED IN PARAGRAPH (a) OF THIS SUBSECTION (13) SHALL BE REPORTED AS FOLLOWS:

(A)  THE LOBBYIST SHALL REPORT THE VALUE OF THE MEAL IN THE LOBBYIST DISCLOSURE STATEMENT FILED PURSUANT TO SECTION 24­6­302, C.R.S.

(B)  THE INCUMBENT OR CANDIDATE SHALL REPORT THE VALUE OF THE MEAL IN THE PUBLIC OFFICIAL DISCLOSURE STATEMENT FILED PURSUANT TO SECTION 24­6­203, C.R.S.".

Page 6, after line 16, insert the following:

"SECTION 5.  24­6­203 (3), Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW PARAGRAPH to read:

24­6­203.  Reporting by incumbents and elected candidates ­ gifts, honoraria, and other benefits ­ penalty. (3)  The report required by subsection (2) of this section shall include the following:

(g)  ANY GIFT OF A MEAL TO A FUND­RAISING EVENT OF A POLITICAL PARTY.

SECTION 6.  24­6­203 (4) (b), Colorado Revised Statutes, is amended to read:

24­6­203.  Reporting by incumbents and elected candidates ­ gifts, honoraria, and other benefits ­ penalty. (4)  The report required by subsection (2) of this section need not include the following:

(b)  Any item of perishable or nonpermanent value, including but not limited to meals, unless such item is required to be reported under paragraph (e) OR (g) of subsection (3) of this section;

SECTION 7.  24­6­301 (1.9) (a) (IV), Colorado Revised Statutes, is amended to read:

24­6­301.  Definitions.  As used in this part 3, unless the context otherwise requires:

(1.9) (a)  "Disclosure statement" means a written statement which contains:

(IV)  The name of any covered official to or for whom expenditures of fifty dollars or more have been made by or on behalf of the disclosing person for gift or entertainment purposes in connection with lobbying OR FOR WHOM AN EXPENDITURE WAS MADE BY OR ON BEHALF OF THE DISCLOSING PERSON FOR A GIFT OF A MEAL AT A FUND­RAISING EVENT OF A POLITICAL PARTY DESCRIBED IN SECTION 1­45­104 (13) (c) (IV), C.R.S., during either the first six months or the second six months of a calendar year and the amount, date, and principal purpose of the gift or entertainment, if the covered official or a member of his OR HER family actually received such gift or entertainment, but expenditures of one dollar or less shall be reported under subparagraph (V) of this paragraph (a). All amounts spent by a professional lobbyist on a covered official for which the lobbyist is reimbursed, or the source of which is a contribution, shall be deemed to be for gift or entertainment purposes.".

FIRST REPORT OF FIRST CONFERENCE COMMITTEE

on HB98-1207

This Report Amends the Rerevised Bill.

To the President of the Senate and the

Speaker of the House of Representatives:

Your first conference committee appointed on HB 98­1207, concerning the transportation of prisoners through the state, has met and reports that it has agreed upon the following:

1.  That the House accede to the Senate amendments made to the bill, as said amendments appear in the rerevised bill.

2.  That, under the authority granted the committee to consider matters not at issue between the houses, the following amendment be recommended:

Amend rerevised bill, page 2, after line 15, insert the following:

"(c)  "SECURE FACILITY" MEANS A COUNTY, CITY AND COUNTY, OR MUNICIPAL JAIL OR A NONSTATE­OWNED PRISON FACILITY, AS DEFINED IN SECTION 17­24­125 (1) (b), C.R.S.";

line 16, strike "(c)" and substitute "(d)";

line 19, strike "(d)" and substitute "(e)" and after "PRISONER", insert "WITHIN,";

strike lines 21 through 26, and substitute the following:

"(2) (a)  A SUPERVISING INDIVIDUAL IN EACH VEHICLE IN WHICH ONE OR MORE PRISONERS ARE BEING TRANSPORTED BY A CONTRACTING ENTITY SHALL MAINTAIN A LOG BOOK THAT DOCUMENTS FOR EACH PRISONER:

(I)  HIS OR HER NAME, DATE OF BIRTH, SOCIAL SECURITY NUMBER, AND ANY PRESCRIBED MEDICATION;

(II)  THE NAME OF THE JURISDICTIONAL AUTHORITY AUTHORIZING THE TRANSPORTATION, THE DATE AND TIME THAT THE PRISONER WAS FIRST PICKED UP, AND THE DATE AND TIME THAT THE PRISONER WAS RELEASED TO THE JURISDICTIONAL AUTHORITY;

(III)  THE DATE, TIME, LENGTH, AND PURPOSE OF ANY STOP MADE BY THE VEHICLE TRANSPORTING ANY PRISONER; AND

(IV)  INFORMATION CONCERNING ANY INJURIES SUFFERED BY THE PRISONER WHILE BEING TRANSPORTED.

(b)  UPON REQUEST, A SUPERVISING INDIVIDUAL SHALL SURRENDER FOR INSPECTION THE LOG BOOK REQUIRED BY PARAGRAPH (a) OF THIS SUBSECTION (2) TO ANY FEDERAL, STATE, COUNTY, OR MUNICIPAL LAW ENFORCEMENT OFFICER.

(3)  WHENEVER A PRISONER IS TRANSPORTED BY A CONTRACTING ENTITY, THE PRISONER:

(a)  AT A MINIMUM, SHALL BE SHACKLED AND PLACED IN A TRANSPORT BELT OR CHAINS WITH HANDCUFFS AND SHALL BE UNDER THE OBSERVATION OF AT LEAST ONE SUPERVISING INDIVIDUAL WHO SHALL REMAIN AWAKE;

(b)  SHALL WEAR A SEAT BELT;

(c)  SHALL NOT BE SHACKLED TO ANOTHER PRISONER; AND

(d)  SHALL HAVE AVAILABLE IN THE VEHICLE IN WHICH THE PRISONER IS BEING TRANSPORTED APPROPRIATE ATTIRE FOR THE SEASON, INCLUDING FOOTWEAR.

(4) (a)  AT LEAST ONCE EVERY TWENTY­FOUR HOURS THAT A PRISONER IS BEING TRANSPORTED BY A CONTRACTING ENTITY, THE PRISONER SHALL BE HOUSED UNSHACKLED IN A CELL AT A SECURE FACILITY FOR A PERIOD OF NOT LESS THAN SIX HOURS AND PERMITTED TO SHOWER AND SLEEP.".

(6)  WHENEVER A VEHICLE TRANSPORTING PRISONERS FOR A CONTRACTING ENTITY ENTERS THE STATE, A SUPERVISING INDIVIDUAL SHALL PROMPTLY NOTIFY THE COLORADO BUREAU OF INVESTIGATION OF THE NUMBER OF PRISONERS AND THE LOCATION OR LOCATIONS WITHIN THE STATE WHERE THE VEHICLE IS SCHEDULED TO STOP.

(7)  WHENEVER A PRISONER IS HOUSED IN A SECURE FACILITY, THE CONTRACTING ENTITY SHALL PAY TO THE OPERATOR OF THE SECURE FACILITY PROVIDING THE HOUSING THE ACTUAL COST OF HOUSING THE PRISONER.".

HB98-1224 by Representative Lawrence; also Senator Arnold--Concerning bail recovery, and, in connection therewith, prohibiting a bail bonding agent from hiring, contracting with, or paying compensation to an individual for bail recovery services unless certain requirements are met.

Under Joint Rule 6(b)(4) Representative Lawrence moved that the House reject the Conference Committee Report, discharge the First Conference Committee for HB98-1224 and that a Second Conference Committee be appointed. The motion was declared passed by the following roll call vote:

HB98-1062 by Representative Paschall; also Senator Arnold--Concerning procedural requirements for the selection of an independent medical examiner in cases of disputes under the "Workers' Compensation Act of Colorado".
