After consideration on the merits, the Committee recommends the following:

HCR98-1008 be amended as follows, and as so amended, be referred to the Committee of the Whole with favorable recommendation:

Amend printed resolution, page 3, strike line 13 and substitute the following:

"FACILITY".

Page 4, line 5, after the period, insert the following:

AMENDMENTS TO THE COMMITTEE OF THE WHOLE REPORT

Representative Adkins moved to amend the Report of the Committee of the Whole to show that the following Adkins amendment, to SB98­109, did pass, and that SB98­109, as amended, did pass:

Amend reengrossed bill, page 8, after line 10, insert the following:

"(III)  Regulation 5­2­9 III. C. 4., concerning an injured party under a managed care plan requesting a PIP examination only after exhausting all complaint and grievance procedures available under the managed care plan, of rules of the commissioner of insurance concerning requesting a PIP examination under the personal injury protection (PIP) examination program (3 CCR 702­5);

(IV)  Regulation 5­2­9 III. C. 5., concerning if an injured person seeking benefits pursuant to a managed care contract chooses to be treated totally outside the network, of rules of the commissioner of insurance concerning requesting a PIP examination under the personal injury protection (PIP) examination program (3 CCR 702­5);".
