A BILL FOR AN ACT

CONCERNING THE AUTHORITY OF THE BOARD OF REGENTS OF THE UNIVERSITY OF COLORADO TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT WITH THE CITY OF AURORA TO PROVIDE UTILITY SERVICES TO PROPERTY LOCATED AT THE UNITED STATES ARMY GARRISON, FITZSIMONS.

Authorizes the board of regents of the university of Colorado to enter into an intergovernmental agreement with the city of Aurora to purchase electric and gas utility service at wholesale, and to purchase or produce steam utility service, and to provide such service to end users within property located within the United States army garrison, Fitzsimons.


Be it enacted by the General Assembly of the State of Colorado:

SECTION 1.  Article 20 of title 23, Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW SECTION to read:

23­20­112.5.  Utility services at university facilities at United States army garrison, Fitzsimons. THE BOARD OF REGENTS MAY ENTER INTO AN AGREEMENT UNDER THE PROVISIONS OF PART 2 OF ARTICLE 1 OF TITLE 29, C.R.S., WITH THE CITY OF AURORA, TO PURCHASE ELECTRIC AND GAS UTILITY SERVICE AT WHOLESALE, AND TO PURCHASE OR PRODUCE STEAM UTILITY SERVICE, AND TO PROVIDE SUCH SERVICE TO END USERS WITHIN PROPERTY LOCATED WITHIN THE BOUNDARIES OF THE UNITED STATES ARMY GARRISON, FITZSIMONS.

SECTION 2.  Effective date. This act shall take effect at 12:01 a.m. on the day following the expiration of the ninety­day period after final adjournment of the general assembly that is allowed for submitting a referendum petition pursuant to article V, section 1 (3) of the state constitution; except that, if a referendum petition is filed against this act or an item, section, or part of this act within such period, then the act, item, section, or part, if approved by the people, shall take effect on the date of the official declaration of the vote thereon by proclamation of the governor.
