An Act

HOUSE BILL 98­1328

BY REPRESENTATIVES Gordon, Chavez, Dean, Musgrave, Paschall, Saliman, Tupa, and S. Williams;

also SENATORS Reeves, Chlouber, and Rupert.


CONCERNING ADDITIONAL RESTRICTIONS ON ACTIVITIES BY MINORS RELATED TO TOBACCO.


Be it enacted by the General Assembly of the State of Colorado:

SECTION 1. 30­15­401, Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW SUBSECTION to read:

30­15­401.  General regulations. (1.5)  IN ADDITION TO ANY OTHER POWERS, THE BOARD OF COUNTY COMMISSIONERS HAS THE POWER TO ADOPT A RESOLUTION OR AN ORDINANCE PROHIBITING MINORS FROM POSSESSING CIGARETTES OR TOBACCO PRODUCTS, AS DEFINED BY SECTION 39­28.5­101 (5), C.R.S.

SECTION 2.  Effective date ­ applicability. This act shall take effect July 1, 1998, and shall apply to offenses committed on or after said date.

SECTION 3.  Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
