A BILL FOR AN ACT

CONCERNING THE REGULATION OF VIDEO LOTTERY TERMINALS AS GAMING DEVICES, AND, IN CONNECTION THEREWITH, INCLUDING VIDEO LOTTERY TERMINALS WITHIN THE DEFINITION OF A SLOT MACHINE AND PROHIBITING THE LOTTERY DIVISION FROM PERMITTING LOTTERY GAMES TO BE PLAYED ON A SLOT MACHINE.

Specifically adds video lottery terminals to the statutory definition of a "slot machine" under the limited gaming statutes. Prohibits the state lottery division from permitting lottery games to be played on a slot machine.


Be it enacted by the General Assembly of the State of Colorado:

SECTION 1.  12­47.1­103 (26) (a), Colorado Revised Statutes, is amended to read:

12­47.1­103.  Definitions. As used in this article, unless the context otherwise requires:

(26) (a)  "Slot machine" means any mechanical, electrical, video, electronic, or other device, contrivance, or machine which, after insertion of a coin, token, or similar object, or upon payment of any required consideration whatsoever by a player, is available to be played or operated, and which, whether by reason of the skill of the player or application of the element of chance, or both, may deliver or entitle the player operating the machine to receive cash premiums, merchandise, tokens, or redeemable game credits, or any other thing of value other than unredeemable free games, whether the payoff is made automatically from the machines or in any other manner. "SLOT MACHINE" INCLUDES, WITHOUT LIMITATION, A VIDEO LOTTERY TERMINAL.

SECTION 2.  24­35­208, Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW SUBSECTION to read:

24­35­208.  Commission ­ powers and duties. (3)  THE COMMISSION SHALL NOT PERMIT LOTTERY GAMES TO BE PLAYED ON OR THROUGH THE USE OF A VIDEO LOTTERY TERMINAL OR ANY OTHER TYPE OF SLOT MACHINE, AS DEFINED IN SECTION 12­47.1­103 (26), C.R.S.

SECTION 3.  Effective date. This act shall take effect at 12:01 a.m. on the day following the expiration of the ninety­day period after final adjournment of the general assembly that is allowed for submitting a referendum petition pursuant to article V, section 1 (3) of the state constitution; except that, if a referendum petition is filed against this act or an item, section, or part of this act within such period, then the act, item, section, or part, if approved by the people, shall take effect on the date of the official declaration of the vote thereon by proclamation of the governor.
