A BILL FOR AN ACT

CONCERNING GRANTING WATER CONSERVATION DISTRICTS POWER TO DEAL WITH CONSERVATION EASEMENTS IN GROSS.

Empowers the Colorado river, Southwestern, and Rio Grande water conservation districts to acquire, accept, hold in the name of the district, manage, operate, transfer, and otherwise deal with conservation easements in gross.



Be it enacted by the General Assembly of the State of Colorado:

SECTION 1.  37­46­107 (1), Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW PARAGRAPH to read:

37­46­107.  General powers. (1)  In its corporate capacity, the district shall have the power:

(m)  TO ACQUIRE, ACCEPT, HOLD IN THE NAME OF THE DISTRICT, MANAGE, OPERATE, TRANSFER, AND OTHERWISE DEAL WITH CONSERVATION EASEMENTS IN GROSS CREATED PURSUANT TO SECTION 38­30.5­101, C.R.S.

SECTION 2.  37­47­107 (1), Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW PARAGRAPH to read:

37­47­107.  Powers of district. (1)  Such district, in its corporate capacity, shall have power:

(m)  TO ACQUIRE, ACCEPT, HOLD IN THE NAME OF THE DISTRICT, MANAGE, OPERATE, TRANSFER, AND OTHERWISE DEAL WITH CONSERVATION EASEMENTS IN GROSS CREATED PURSUANT TO SECTION 38­30.5­101, C.R.S.

SECTION 3.  37­48­105 (1), Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW PARAGRAPH to read:

37­48­105.  Powers of district. (1)  The district, in its corporate capacity, shall have power to:

(m)  ACQUIRE, ACCEPT, HOLD IN THE NAME OF THE DISTRICT, MANAGE, OPERATE, TRANSFER, AND OTHERWISE DEAL WITH CONSERVATION EASEMENTS IN GROSS CREATED PURSUANT TO SECTION 38­30.5­101, C.R.S.

SECTION 4.  Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
