A BILL FOR AN ACT

CONCERNING A REDEVELOPMENT PLAN FOR THE PROPERTY BEING VACATED BY THE UNIVERSITY OF COLORADO HEALTH SCIENCES CENTER WHEN IT MOVES TO FITZSIMONS.

Bill Summary

Creates a committee to study and propose alternative plans for the redevelopment of the property that will be vacated when the university of Colorado health sciences center moves to the former Fitzsimons army base. Sets forth the membership of the committee. Specifies the issues the committee should study and directs the committee to develop alternative proposed redevelopment plans. Authorizes the committee to contract with a consultant to work on the alternative proposed redevelopment plans.

Permits the committee to conduct surveys and to hold public hearings regarding potential uses and redevelopment proposals for the property. Directs the committee to submit its written report and findings to the general assembly, the city and county of Denver, the university of Colorado health sciences center, and the board of regents of the university of Colorado.

Provides that expenses of the committee shall be paid for out of the existing budget of the university of Colorado health sciences center for the planning, preparation, transition, and move to Fitzsimons.


Be it enacted by the General Assembly of the State of Colorado:

SECTION 1.  Article 20 of title 23, Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW SECTION to read:

23­20­136.  University of Colorado health sciences center ­ redevelopment plan for property. (1)  THE GENERAL ASSEMBLY HEREBY RECOGNIZES THAT THE UNIVERSITY OF COLORADO HEALTH SCIENCES CENTER IS PLANNING TO RELOCATE ITS FACILITIES FROM ITS PRESENT LOCATION TO THE FORMER FITZSIMONS ARMY BASE. BECAUSE OF THE SIGNIFICANT IMPACT THAT SUCH A MOVE WILL HAVE ON THE NEIGHBORHOODS AND BUSINESSES ADJOINING ITS CURRENT LOCATION AND ON THE CITY AND COUNTY OF DENVER AND THE STATE, THE GENERAL ASSEMBLY HEREBY DECLARES THAT IT IS IMPORTANT THAT A REDEVELOPMENT PLAN BE DESIGNED TO ADDRESS THE CHALLENGES AND OPPORTUNITIES THAT ARE PRESENTED BY THE VACATING OF THE PROPERTY AT WHICH THE UNIVERSITY OF COLORADO HEALTH SCIENCES CENTER IS CURRENTLY LOCATED.

(2)  THERE IS HEREBY CREATED THE HEALTH SCIENCES CENTER TRANSITION AND REDEVELOPMENT COMMITTEE FOR THE PURPOSE OF DEVELOPING ALTERNATIVE PLANS FOR THE INTERMEDIATE AND LONG­TERM REDEVELOPMENT OF THE EXISTING CAMPUS AT NINTH AVENUE AND COLORADO BOULEVARD IN THE CITY AND COUNTY OF DENVER WHICH WILL BE VACATED WHEN THE UNIVERSITY OF COLORADO HEALTH SCIENCES CENTER RELOCATES TO THE FORMER FITZSIMONS ARMY BASE. THE REDEVELOPMENT COMMITTEE SHALL ALSO PROPOSE REDEVELOPMENT OPTIONS FOR SAID PROPERTY AND IDENTIFY FUNDING REQUIREMENTS FOR SUCH OPTIONS. THE COMMITTEE SHALL BE COMPOSED OF REPRESENTATIVES DESIGNATED OR APPOINTED BY THE FOLLOWING ENTITIES, ORGANIZATIONS, AND OFFICIALS:

(a)  TWO MEMBERS OF THE CITY COUNCIL FOR THE CITY AND COUNTY OF DENVER WHO REPRESENT DISTRICTS IMPACTED BY THE HEALTH SCIENCES CENTER RELOCATION;

(b)  A REPRESENTATIVE OF THE DENVER PLANNING AND DEVELOPMENT OFFICE;

(c)  A REPRESENTATIVE OF THE MAYOR'S OFFICE OF ECONOMIC DEVELOPMENT FOR THE CITY AND COUNTY OF DENVER;

(d)  A REPRESENTATIVE OF EACH OF THE FOLLOWING DENVER NEIGHBORHOODS APPOINTED BY THE RESPECTIVE NEIGHBORHOOD ASSOCIATION OR GROUP FOR THAT NEIGHBORHOOD: CONGRESS PARK, BELLEVUE­HALE, CRANMER PARK­HILLTOP, MAYFAIR, AND CAPITOL HILL;

(e)  A REPRESENTATIVE OF THE COLORADO BOULEVARD HEALTH FACILITIES TRANSPORTATION MANAGEMENT ORGANIZATION;

(f)  A REPRESENTATIVE OF THE DENVER METROPOLITAN CHAMBER OF COMMERCE;

(g)  THREE REPRESENTATIVES OF THE UNIVERSITY OF COLORADO HEALTH SCIENCES CENTER, INCLUDING ONE MEMBER OF THE SCHOOL OF MEDICINE AND TWO MEMBERS WHO SHALL REPRESENT THE OTHER SCHOOLS AND OFFICES LOCATED ON THE HEALTH SCIENCES CENTER CAMPUS;

(h)  A MEMBER OF THE UNIVERSITY OF COLORADO BOARD OF REGENTS OR A DESIGNEE;

(i)  A REPRESENTATIVE OF ROSE MEDICAL CENTER;

(j)  A REPRESENTATIVE OF UNIVERSITY HOSPITAL;

(k)  A REPRESENTATIVE OF THE UNIVERSITY HOSPITAL BOARD OF DIRECTORS; AND

(l)  A REPRESENTATIVE OF THE UNIVERSITY OF COLORADO DESIGN REVIEW BOARD.

(3)  MEMBERS OF THE COMMITTEE SHALL BE DESIGNATED OR APPOINTED BY THE APPROPRIATE ENTITY, ORGANIZATION, OR OFFICIAL AS SOON AS PRACTICABLE BUT NO LATER THAN JULY 1, 1998. MEMBERS OF THE COMMITTEE SHALL SERVE WITHOUT COMPENSATION. THE MEMBERS OF THE COMMITTEE SHALL ELECT A CHAIR AND VICE­CHAIR FOR THE COMMITTEE.

(4)  THE COMMITTEE SHALL:

(a)  INVESTIGATE AND DETERMINE THE PLANS FOR THE MOVE BY THE HEALTH SCIENCES CENTER TO FITZSIMONS, INCLUDING BUT NOT LIMITED TO THE LENGTH OF TIME FOR THE MOVE, HOW THE MOVE WILL BE CONDUCTED, AND WHETHER THE MOVE WILL BE PHASED­OUT OVER A CERTAIN TIME PERIOD OR WHETHER THE MOVE WILL OCCUR ALL AT ONCE;

(b)  EXAMINE EXISTING PLANS AND WHETHER THERE ARE INTERIM USES FOR THE PROPERTY THAT WILL BE VACATED; AND

(c)  STUDY THE ISSUES AFFECTING THE SURROUNDING NEIGHBORHOODS PRIOR TO, DURING, AND AFTER THE MOVE.

(5)  ONCE THE COMMITTEE HAS OBTAINED THE INFORMATION DESCRIBED IN SUBSECTION (4) OF THIS SECTION, THE COMMITTEE SHALL DEVELOP PROPOSED ALTERNATIVE PLANS FOR REDEVELOPMENT OF THE PROPERTY BEING VACATED. THE COMMITTEE IS AUTHORIZED TO CONTRACT WITH A CONSULTANT TO DEVELOP THE ALTERNATIVE REDEVELOPMENT PLANS. IN CONSIDERING AND PROPOSING ALTERNATIVE REDEVELOPMENT PLANS, THE COMMITTEE SHALL CONSIDER THE FOLLOWING:

(a)  LAND USE ISSUES, INCLUDING WHAT LAND USES ARE APPROPRIATE FOR THE VACATED PROPERTY AND WHAT URBAN DESIGN FACTORS ARE MANDATED TO MITIGATE ANY EFFECTS OF SAID LAND USES ON SURROUNDING PROPERTIES;

(b)  ISSUES AFFECTING THE TRANSPORTATION NEEDS AND DEMANDS OF THE AREA;

(c)  THE TYPE OF TENANTS THAT MIGHT BE ATTRACTED TO THE EXISTING BUILDINGS AND REAL PROPERTY;

(d)  THE POSSIBILITY AND MERITS OF SALE OR LEASE OF STATE PROPERTY OR RELOCATION OF OTHER STATE AGENCIES TO THE VACATED PROPERTY;

(e)  OTHER ISSUES DEEMED APPROPRIATE BY THE COMMITTEE.

(6)  EACH PROPOSED ALTERNATIVE REDEVELOPMENT PLAN, SHALL INCLUDE THE FOLLOWING:

(a)  IDENTIFICATION OF LAND USE ISSUES;

(b)  IDENTIFICATION OF TRANSPORTATION ISSUES;

(c)  AN ANALYSIS OF THE SOCIAL AND ECONOMIC IMPACTS ON THE SURROUNDING NEIGHBORHOODS AND BUSINESSES, THE CITY AND COUNTY OF DENVER, AND THE STATE;

(d)  A SCHEDULE FOR PHASING­IN THE PLAN, IDENTIFYING BOTH LONG­ AND SHORT­TERM USES THAT OPTIMIZE OPPORTUNITIES, APPEARANCE, EXTERNAL EFFECTS, AND ECONOMIC RETURN;

(e)  THE FISCAL IMPACT OF THE PLAN, INCLUDING THE FISCAL IMPACT ON THE STATE AND ON THE CITY AND COUNTY OF DENVER.

(7)  THE COMMITTEE MAY CONDUCT SURVEYS AND COLLECT DATA TO ASSIST THE COMMITTEE IN ANALYZING THE MOVE AND ITS IMPACT ON THE COMMUNITY. THE COMMITTEE MAY HOLD PUBLIC HEARINGS REGARDING PROPOSED USES AND REDEVELOPMENT PLANS FOR THE AREA.

(8)  STAFF SERVICES AND SUPPORT SHALL BE PROVIDED TO THE COMMITTEE BY THE UNIVERSITY OF COLORADO HEALTH SCIENCES CENTER. EXPENSES OF THE COMMITTEE AND ANY CONSULTING FEES SHALL BE PAID FOR OUT OF THE EXISTING BUDGET OF THE UNIVERSITY OF COLORADO HEALTH SCIENCES CENTER DESIGNATED FOR THE PLANNING, PREPARATION, TRANSITION, AND MOVE FROM THE EXISTING CAMPUS TO FITZSIMONS. IN ADDITION, THE COMMITTEE MAY REQUEST THE ASSISTANCE OF AND ANY INFORMATION FROM THE DEPARTMENT OF PERSONNEL REGARDING THE OFFICE BUILDING NEEDS OF STATE AGENCIES.

(9)  ON OR BEFORE AUGUST 31, 1998, THE COMMITTEE SHALL PRESENT A WRITTEN PLAN AND ITS FINDINGS AND RECOMMENDATIONS CONCERNING REDEVELOPMENT OF THE AFFECTED AREA TO THE GENERAL ASSEMBLY, THE CITY AND COUNTY OF DENVER, THE UNIVERSITY OF COLORADO HEALTH SCIENCES CENTER, AND THE BOARD OF REGENTS OF THE UNIVERSITY OF COLORADO.

SECTION 2.  No appropriation. The general assembly has determined that this act can be implemented within existing appropriations, and therefore no separate appropriation of state moneys is necessary to carry out the purposes of this act.

SECTION 3.  Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
