A BILL FOR AN ACT

CONCERNING MAKING A VIOLATION OF MOTOR VEHICLE SAFETY BELT REQUIREMENTS A PRIMARY OFFENSE.

Makes a violation of the current safety belt requirements for drivers and front seat passengers in motor vehicles a primary offense.


Be it enacted by the General Assembly of the State of Colorado:

SECTION 1.  Repeal.  42­4­237 (5), Colorado Revised Statutes, is repealed as follows:

42­4­237.  Safety belt systems ­ mandatory use ­ exemptions ­ penalty. (5)  No driver in a motor vehicle shall be cited for a violation of subsection (2) of this section unless such driver was stopped by a law enforcement officer for an alleged violation of articles 1 to 4 of this title other than a violation of this section.

SECTION 2.  Effective date ­ applicability. This act shall take effect July 1, 1998, and shall apply to offenses committed on or after said date.

SECTION 3.  Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
