A BILL FOR AN ACT

CONCERNING FUNDING FOR CHARTER SCHOOLS.

Increases the minimum amount of funding for charter schools to 90% of per pupil revenues for pupils in kindergarten and first through 5th grades, 92.5% of per pupil revenues for pupils in 6th through 8th grades, and 95% of per pupil revenues for pupils in 9th through 12th grades.


Be it enacted by the General Assembly of the State of Colorado:

SECTION 1.  22­30.5­112 (2) (a) and (2) (c), Colorado Revised Statutes, are amended to read:

22­30.5­112.  Charter schools ­ financing ­ guidelines. (2) (a) (I)  EXCEPT AS OTHERWISE PROVIDED IN SUBPARAGRAPH (II) OF THIS PARAGRAPH (a), as part of the charter school contract, the charter school and the school district shall agree on funding and any services to be provided by the school district to the charter school. The charter school and the school district shall begin discussions on the contract using eighty percent of the district per pupil operating revenues.

(II)  EFFECTIVE JULY 1, 1999, THE CHARTER SCHOOL AND THE SCHOOL DISTRICT SHALL BEGIN DISCUSSIONS FOR FUNDING UNDER THE CONTRACT USING:

(A)  NINETY PERCENT OF THE DISTRICT PER PUPIL REVENUES FOR ANY PUPILS ENROLLED IN THE EQUIVALENT OF KINDERGARTEN AND FIRST THROUGH FIFTH GRADES AT THE CHARTER SCHOOL;

(B)  NINETY­TWO AND FIVE­TENTHS PERCENT OF THE DISTRICT PER PUPIL REVENUES FOR ANY PUPILS ENROLLED IN THE EQUIVALENT OF SIXTH THROUGH EIGHTH GRADES AT THE CHARTER SCHOOL; AND

(C)  NINETY­FIVE PERCENT OF THE DISTRICT PER PUPIL REVENUES FOR ANY PUPILS ENROLLED IN THE EQUIVALENT OF NINTH THROUGH TWELFTH GRADES AT THE CHARTER SCHOOL.

(III)  As used in this subsection (2):

(A)  District "per pupil operating revenues" shall have the same meaning as that provided in section 22­54­103 (9).

(B)  "DISTRICT PER PUPIL REVENUES" MEANS THE DISTRICT'S TOTAL PROGRAM AS DEFINED IN SECTION 22-54-103 (6) FOR ANY BUDGET YEAR DIVIDED BY THE DISTRICT'S FUNDED PUPIL COUNT AS DEFINED IN SECTION 22-54-103 (7) FOR SAID BUDGET YEAR.

(c)  In no event shall the amount of funding negotiated pursuant to this subsection (2) be less than eighty percent of the district per pupil operating revenues multiplied by the number of pupils enrolled in the charter school; EXCEPT THAT, EFFECTIVE JULY 1, 1999, THE AMOUNT OF FUNDING NEGOTIATED PURSUANT TO THIS SUBSECTION (2) SHALL NOT BE LESS THAN THE PERCENTAGES OF DISTRICT PER PUPIL REVENUES SPECIFIED IN PARAGRAPH (a) OF THIS SUBSECTION (2) MULTIPLIED BY THE NUMBER OF PUPILS ENROLLED IN THE CHARTER SCHOOL AT EACH OF THE SPECIFIED GRADE LEVELS.

SECTION 2.  Safety clause.  The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
