A BILL FOR AN ACT

CONCERNING INCLUDING MOTORCYCLES IN THE DEFINITION OF MOTOR VEHICLES FOR PURPOSES OF MOTOR VEHICLE WARRANTIES.

Be it enacted by the General Assembly of the State of Colorado:

SECTION 1.  42­10­101 (2), Colorado Revised Statutes, is amended to read:

42­10­101.  Definitions. As used in this article, unless the context otherwise requires:

(2)  "Motor vehicle" means a self­propelled private passenger vehicle, including pickup trucks, and vans, AND MOTORCYCLES AS DEFINED IN SECTION 42­1­102 (55), designed primarily for travel on the public highways and used to carry not more than ten persons, which is sold to a consumer in this state; except that the term does not include motor homes as defined in section 42­1­102 (57) or vehicles THAT ARE NOT MOTORCYCLES AND ARE designed to travel on three or fewer wheels in contact with the ground.

SECTION 2.  Effective date ­ applicability. (1)  This act shall take effect at 12:01 a.m. on the day following the expiration of the ninety­day period after final adjournment of the general assembly that is allowed for submitting a referendum petition pursuant to article V, section 1 (3) of the state constitution; except that, if a referendum petition is filed against this act or an item, section, or part of this act within such period, then the act, item, section, or part, if approved by the people, shall take effect on the date of the official declaration of the vote thereon by proclamation of the governor.

(2)  The provisions of this act shall apply to motorcycles purchased by a consumer on or after the applicable effective date of this act.
