A BILL FOR AN ACT

CONCERNING A REQUIREMENT TO REPORT THE USE OF AT­RISK PUPIL FUNDING.

Beginning October 1, 1998, requires each school district that receives funding for at­risk pupils to submit to the department of education an annual report of the use of said funding. Specifies the information to be included in the report. Beginning January 1, 1999, requires the department to submit to the governor and to the education committees of the senate and the house of representatives an annual compilation of the school district reports on the use of at­risk pupil funding.

Prohibits the commissioner of education from waiving the requirement to report the use of at­risk pupil funding.


Be it enacted by the General Assembly of the State of Colorado:

SECTION 1.  Article 54 of title 22, Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW SECTION to read:

22­54­122.  At­risk funding ­ annual report. (1)  ON OR BEFORE OCTOBER 1, 1998, AND ON OR BEFORE EACH OCTOBER 1 THEREAFTER, EACH SCHOOL DISTRICT THAT RECEIVES FUNDING FOR AT­RISK PUPILS PURSUANT TO THIS ARTICLE SHALL SUBMIT A REPORT TO THE DEPARTMENT OF EDUCATION DISCUSSING THE USE OF SAID FUNDS. AT A MINIMUM, THE ANNUAL REPORT SHALL INCLUDE THE FOLLOWING INFORMATION FOR THE PREVIOUS BUDGET YEAR:

(a)  THE NUMBER OF AT­RISK PUPILS ENROLLED IN THE SCHOOL DISTRICT;

(b)  THE NUMBER OF AT­RISK PUPILS ENROLLED IN EACH ELEMENTARY SCHOOL, MIDDLE SCHOOL, HIGH SCHOOL, CHARTER SCHOOL, AND ALTERNATIVE SCHOOL IN THE SCHOOL DISTRICT;

(c)  THE AMOUNT OF FUNDING FOR AT­RISK PUPILS RECEIVED BY THE SCHOOL DISTRICT;

(d)  THE PURPOSES FOR WHICH THE SCHOOL DISTRICT USED THE FUNDING RECEIVED FOR AT­RISK PUPILS.

(2)  ON OR BEFORE JANUARY 1, 1999, AND ON OR BEFORE EACH JANUARY 1 THEREAFTER, THE DEPARTMENT OF EDUCATION SHALL SUBMIT TO THE GOVERNOR AND TO THE EDUCATION COMMITTEES OF THE SENATE AND THE HOUSE OF REPRESENTATIVES A COMPILATION OF THE SCHOOL DISTRICT REPORTS RECEIVED PURSUANT TO SUBSECTION (1) OF THIS SECTION.

SECTION 2.  22­2­116, Colorado Revised Statutes, is amended to read:

22­2­116.  Additional power ­ waiver of reporting requirements. (1)  EXCEPT AS OTHERWISE PROVIDED IN SUBSECTION (2) OF THIS SECTION, the commissioner may waive any requirements imposed by this title as to the reporting of data to the department or the state board by any school district which THAT is eligible to receive the minimum amount of state moneys under the provisions of article 54 of this title, if the commissioner finds that any benefits from receiving such reports are outweighed by the district's increased administrative costs of reporting in light of its minimum share of state moneys.

(2)  THE PROVISIONS OF THIS SECTION SHALL NOT APPLY TO THE ANNUAL REPORT OF THE USE OF FUNDING RECEIVED FOR AT­RISK PUPILS REQUIRED UNDER SECTION 22­54­122.

SECTION 3.  Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
