A BILL FOR AN ACT

CONCERNING REQUIREMENTS FOR THE ISSUANCE OF STATE IDENTIFICATION CARDS BY THE DEPARTMENT OF REVENUE TO DISABLED PERSONS.

Allows a disabled person to use a statement from a federal, state, Colorado county, or Colorado city and county agency that the identity and birth date of such person has been established as a substitute for the birth certificate otherwise required for the issuance of a state identification card.

Allows an applicant to show proof of disability to the department of revenue by providing documentation from a federal, state, Colorado county, or Colorado city and county agency or a medical assistance card.

Be it enacted by the General Assembly of the State of Colorado:

SECTION 1.  42­2­302 (2), Colorado Revised Statutes, is amended to read:

42­2­302.  Department may issue ­ limitations. (2) (a)  The department shall issue an identification card only upon the furnishing of a birth certificate or other documentary evidence of identity that the department may require. The department may assess a fee under section 42­2­306 (1) (b) if the department is required to undertake additional efforts to verify the identity of the applicant.

(b) (I)  THE DEPARTMENT MAY ACCEPT FROM A DISABLED APPLICANT AS A SUBSTITUTE FOR THE BIRTH CERTIFICATE REQUIRED PURSUANT TO PARAGRAPH (a) OF THIS SUBSECTION (2) DOCUMENTATION FROM A FEDERAL, STATE, COLORADO COUNTY, OR COLORADO CITY AND COUNTY AGENCY THAT THE IDENTITY AND BIRTH DATE OF SUCH PERSON HAS BEEN ESTABLISHED BY THAT AGENCY.

(II)  METHODS AN APPLICANT MAY USE TO SHOW PROOF OF DISABILITY TO THE DEPARTMENT INCLUDE, BUT ARE NOT LIMITED TO, PROVIDING DOCUMENTATION FROM A FEDERAL, STATE, COLORADO COUNTY, OR COLORADO CITY AND COUNTY AGENCY OR A MEDICAL ASSISTANCE CARD.

SECTION 2.  Effective date ­ applicability. (1)  This act shall take effect at 12:01 a.m. on the day following the expiration of the ninety­day period after final adjournment of the general assembly that is allowed for submitting a referendum petition pursuant to article V, section 1 (3) of the state constitution; except that, if a referendum petition is filed against this act or an item, section, or part of this act within such period, then the act, item, section, or part, if approved by the people, shall take effect on the date of the official declaration of the vote thereon by proclamation of the governor.

(2)  The provisions of this act shall apply to identification cards issued on or after the applicable effective date of this act.
