A BILL FOR AN ACT

CONCERNING FUNDING FOR AT­RISK STUDENTS ENROLLED IN CHARTER SCHOOLS.

For charter schools initially approved or renewed on or after July 1, 1998, requires the charter school to receive 100% of the district per pupil operating revenues for each at­risk pupil enrolled in the charter school.


Be it enacted by the General Assembly of the State of Colorado:

SECTION 1.  22­30.5­112 (2) (a), Colorado Revised Statutes, is amended to read:

22­30.5­112.  Charter schools ­ financing ­ guidelines. (2) (a)  As part of the charter school contract, the charter school and the school district shall agree on funding and any services to be provided by the school district to the charter school. The charter school and the school district shall begin discussions on the contract using eighty percent of the district per pupil operating revenues; EXCEPT THAT, FOR CHARTER SCHOOLS APPROVED OR RENEWED ON OR AFTER JULY 1, 1998, THE CHARTER SCHOOL SHALL RECEIVE AT LEAST ONE HUNDRED PERCENT OF THE DISTRICT PER PUPIL OPERATING REVENUES FOR EACH AT­RISK PUPIL ENROLLED IN THE CHARTER SCHOOL. As used in this subsection (2):

(I)  "AT­RISK PUPIL" SHALL HAVE THE SAME MEANING AS THAT PROVIDED IN SECTION 22­54­103 (1).

(II)  District "per pupil operating revenues" shall have the same meaning as that provided in section 22­54­103 (9).

SECTION 2.  Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
