A BILL FOR AN ACT

CONCERNING REIMBURSEMENT UNDER THE MEDICAID PROGRAM FOR PERSONAL CARE SERVICES PROVIDED BY A FAMILY MEMBER.

Changes the cap for personal care services provided by a family member from five thousand dollars per year to an amount based upon rates set by the state department of health care policy and financing for services that do not exceed two hours per day per year.


Be it enacted by the General Assembly of the State of Colorado:

SECTION 1.  26­4­609, Colorado Revised Statutes, is amended to read:

26­4­609.  Special provisions ­ personal care services provided by a family. (1)  A member of an eligible person's family, other than the person's spouse, may be employed to provide personal care services to such person.

(2)  The maximum reimbursement for the services provided by a member of the person's family per year for each client shall not exceed five thousand dollars per family per year. A MEMBER OF THE ELIGIBLE PERSON'S FAMILY MAY ONLY BE REIMBURSED FOR SERVICES NOT TO EXCEED TWO HOURS PER DAY PER YEAR. SUCH REIMBURSEMENT SHALL BE BASED UPON RATES SET BY THE STATE DEPARTMENT.

SECTION 2.  Effective date. This act shall take effect July 1, 1998.

SECTION 3.  Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
