A BILL FOR AN ACT

CONCERNING THE AUTHORIZATION OF THE STATE LOTTERY DIVISION TO CONDUCT INSTANT SCRATCH LOTTERIES BASED UPON THE GAME OF CHANCE COMMONLY KNOWN AS BINGO.

Permits the state lottery division to conduct instant scratch lotteries based upon the game of chance known as bingo.


Be it enacted by the General Assembly of the State of Colorado:

SECTION 1.  24­35­208 (2) (a), Colorado Revised Statutes, is amended to read:

24­35­208.  Commission ­ powers and duties. (2)  Rules and regulations promulgated pursuant to subsection (1) of this section shall include, but shall not be limited to, the following:

(a)  The types of lotteries to be conducted, but no lottery conducted under this part 2, EXCEPT FOR INSTANT SCRATCH LOTTERIES, shall be based upon the game of chance commonly known as bingo, nor shall any lottery be conducted which THAT depends upon the outcome of any athletic contest except races at state­licensed dog or horse tracks if approved by the Colorado racing commission;

SECTION 2.  Effective date.  This act shall take effect at 12:01 a.m. on the day following the expiration of the ninety­day period after final adjournment of the general assembly that is allowed for submitting a referendum petition pursuant to article V, section 1 (3) of the state constitution; except that, if a referendum petition is filed against this act or an item, section, or part of this act within such period, then the act, item, section, or part, if approved by the people, shall take effect on the date of the official declaration of the vote thereon by proclamation of the governor.
