CONCERNING REPORTING IN LOCAL GOVERNMENT ELECTIONS
PURSUANT TO THE "FAIR CAMPAIGN PRACTICES ACT".
Be it enacted by the General Assembly of the State
of Colorado:
SECTION 1. 145103
(8), Colorado Revised Statutes, is amended, and the said 145103
is further amended BY THE ADDITION OF A NEW SUBSECTION, to read:
145103. Definitions. As
used in this article:
(1.5) "APPROPRIATE OFFICER"
MEANS THE INDIVIDUAL WITH WHOM A CANDIDATE, CANDIDATE COMMITTEE,
POLITICAL COMMITTEE, OR ISSUE COMMITTEE MUST FILE PURSUANT TO
SECTION 145109 (1).
(8) "Issue committee" means
two or more persons who are elected, appointed, or chosen, or
have associated themselves, for the purpose of accepting contributions
and making expenditures to support or oppose any ballot initiative
or referendum ISSUE OR BALLOT QUESTION.
"Issue committee" does not include political parties,
political committees, or candidate committees as otherwise defined
in this section.
SECTION 2. 145108
(1) and (2) (a) and the introductory portion to 145108
(3), Colorado Revised Statutes, are amended to read:
145108. Disclosure.
(1) All candidate committees, political committees,
issue committees, and political parties shall report to the secretary
of state APPROPRIATE OFFICER their
contributions received, including the name and address of each
person who has contributed twenty dollars or more; expenditures
made; and obligations entered into by the committee or party.
(2) (a) Such reports THAT ARE REQUIRED
TO BE FILED WITH THE SECRETARY OF STATE shall be filed quarterly
in offelection years and on the first day of each month
beginning the sixth full month before the major election AND fourteen
days before and thirty days after the major election in election
years. SUCH REPORTS THAT ARE REQUIRED TO BE FILED WITH THE COUNTY
CLERK AND RECORDER OR WITH THE MUNICIPAL CLERK SHALL BE FILED
ON THE TWENTYFIRST DAY AND ON THE FRIDAY BEFORE AND THIRTY
DAYS AFTER THE PRIMARY ELECTION, WHERE APPLICABLE, AND THE MAJOR
ELECTION IN ELECTION YEARS AND ANNUALLY IN OFFELECTION YEARS
ON THE FIRST DAY OF THE MONTH IN WHICH THE ANNIVERSARY OF THE
MAJOR ELECTION OCCURS.
(3) All candidate committees, political
committees, issue committees, and political parties shall register
with the secretary of state
APPROPRIATE OFFICER before accepting or making any contributions.
Registration shall include a statement listing:

clause. The general assembly hereby finds, determines,
and declares that this act is necessary for the immediate preservation
of the public peace, health, and safety.
