CONCERNING CONTINUATION OF THE PUBLIC UTILITIES COMMISSION
IN THE DEPARTMENT OF REGULATORY AGENCIES.
Be it enacted by the General Assembly of the State
of Colorado:
SECTION 1. 402101
(3) (b), Colorado Revised Statutes, is amended to read:
402101. Creation
appointment term subject to termination repeal
of article. (3) (b) This
article is repealed, effective July
1, 1998 JULY 1, 2003.
SECTION 2. Repeal.
2434104 (27) (c), Colorado Revised Statutes, is repealed
as follows:
2434104. General assembly
review of regulatory agencies and functions for termination, continuation,
or reestablishment. (27) (c) The
following division in the department of regulatory agencies shall
terminate on July 1, 1998: The public utilities commission, created
by article 2 of title 40, C.R.S.
SECTION 3. 2434104
(32.5), Colorado Revised Statutes, is amended BY THE ADDITION
OF A NEW PARAGRAPH to read:
2434104. General assembly
review of regulatory agencies and functions for termination, continuation,
or reestablishment. (32.5) The
following agencies, functions, or both, shall terminate on July
1, 2003:
(d) THE PUBLIC UTILITIES COMMISSION, CREATED
BY ARTICLE 2 OF TITLE 40, C.R.S.
SECTION 4. Effective
date. This act shall take effect July 1, 1998.
SECTION 5. Safety
clause. The general assembly hereby finds, determines, and
declares that this act is necessary for the immediate preservation
of the public peace, health, and safety.
