TITLE:            CONCERNING THE DEFINITION OF “EROTIC NUDITY” AS IT APPLIES TO THE CRIME OF SEXUAL EXPLOITATION OF CHILDREN.



Summary of Assessment


            This bill changes the definition of “erotic nudity” under Section 18-6-403 C.R.S., Sexual Exploitation of Children. The bill would change the requirement that the display of certain portions of the body be for the purpose of real or simulated overt sexual gratification or stimulation of one or more of the persons involved and requires, instead, that the exhibition be lascivious.


            The bill may have an affect on an individual in a court of law, however there would be no cost to the State. Therefore, it is assessed as having no fiscal impact.


            This bill would take effect July 1, 1998 and would apply to offenses committed on or after that date.
