TITLE:            CONCERNING ENABLING LAW ENFORCEMENT OFFICERS TO USE PHOTOGRAPHIC DOCUMENTS ISSUED BY THE DEPARTMENT OF REVENUE TO DETERMINE WHETHER A PERSON HAS BEEN CONVICTED OF A SERIOUS CRIMINAL OFFENSE.



Summary of Legislation


            A person would have to indicate whether or not they had been convicted of a felony in the last ten years when applying for or renewing a driver's license or identification card. A person who would be found to have been convicted of a felony in the last ten years or who failed to indicate that they were a convicted felon would have their driver's license or identification card revoked for one year. The driver’s license and identification card would be modified to indicate the person was a convicted felon. The reference on the driver’s license or identification card would be removed if the felony were to be vacated or more than ten years have elapsed. The bill will become effective at 12:01 a.m. on the day following the ninety-day period after adjournment sine die of the General Assembly, or on the date of the official declaration of the vote of the people as proclaimed by the Governor, if a referendum petition is filed pursuant to Article V, Section 1 (3) of the State Constitution.

State Expenditures


            The driver’s license and identification card system is done on a contract basis with a private vendor. Including an additional item that is noted on the license or card would cost the state approximately $7,500 in General Funds. It should be noted that the existing contract with the vendor is about to expire and that this cost may be included in the next contract negotiation.


Spending Authority


            This fiscal note implies that the Department of Revenue would require $7,500 in General Fund spending authority for FY 1998-99 to implement this bill.
