TITLE:            CONCERNING REQUIREMENTS RELATING TO ANATOMICAL GIFTS UNDER THE "UNIFORM ANATOMICAL GIFT ACT", AND, IN CONNECTION THEREWITH, DELETING REQUIREMENTS FOR WITNESSES TO ANATOMICAL GIFT DOCUMENTS AND HLA TYPING INFORMATION ON DRIVERS' LICENSES AND IDENTIFICATION CARDS, CLARIFYING THE REVOCABILITY AND IRREVOCABILITY OF SUCH GIFTS, MAKING THE FORM PLACED ON DRIVERS' LICENSES AND IDENTIFICATION CARDS CONSISTENT WITH SUCH CHANGES, AND CLARIFYING PROVISIONS RELATING TO THE ADMINISTRATION OF THE ORGAN AND TISSUE DONATION AWARENESS FUND.


Summary of Legislation


            The bill would delete the requirement that Colorado drivers' licenses and identification cards must contain space to indicate the results of HLA typing information for purposes of matching anatomical gifts for transplants. An anatomical gift would become irrevocable and would not require additional concurrence of any person after the donor's death unless the donor revoked the gift prior to death. A person would be able to indicate at any time the donation of body parts by signing the reverse of the license or card. The requirement for two witnesses would be removed. Moneys in the Organ and Tissue Donation Awareness Fund would be continuously appropriated to the Department of the Treasury for quarterly transfer to the Transplant Council of the Rockies. Interest earned on moneys in the fund would be retained and not credited the General Fund. The fifteen percent management fee charged by the state treasurer would not apply. The Department of Revenue would not be able to recover administrative costs of collecting moneys donated to the fund. The bill would become effective upon the Governor’s signature.

State Revenues


            The Organ and Tissue Donation Awareness Fund is estimated to receive between $200,000 and $300,000 annually. Under current law, interest earning have been deposited into the General Fund. The bill would allow the fund to keep the interest earnings and thereby reduce revenues to the General Fund by an estimated $12,000 to $18,000 annually.


            The bill also allows for the continuous appropriations of the money in this fund and removes the General Assembly’s ability to appropriate to this fund.


State Expenditures


            The changes required by the Department of Revenue are minimal and would not require a change in expenditure levels. The State Treasury would not have an impact from this bill that would require a change in their appropriation level.

            This fiscal note implies that no change in spending authority would be required to implement this bill.
