TITLE:            CONCERNING AN EXEMPTION FROM EMISSION INSPECTION REQUIREMENTS FOR THE SALE OF A MOTOR VEHICLE IF SUFFICIENT NOTICE IS PROVIDED TO THE PURCHASER.


Summary of Assessment


            The bill would exempt a vehicle from the requirement that a seller provide a certificate of emissions prior to the sale if the seller provides a written notice that the vehicle does not comply with the emissions requirement, that the seller does not warrant that the vehicle will meet emissions requirements, and that the purchaser is responsible for complying with emissions requirements. This bill would become effective upon the Governor’s signature.


            The bill would place the responsibility for emissions testing and compliance upon the purchaser of a vehicle in cases where the purchaser has received written notice that the vehicle does not meet emissions standards. A purchaser would still be responsible to obtain an emissions test before registering a vehicle. The form the Department of Revenue would be required to create would not require additional resources. The bill would not increase or decrease revenue or expenditures to state or local governments. Therefore, this bill is assessed as having no fiscal impact.
