TITLE: CONCERNING THE CONDITIONS UNDER WHICH A HEALTH CARE COVERAGE ENTITY MAY MODIFY BENEFITS WITHIN AN EXISTING SMALL GROUP OR INDIVIDUAL HEALTH BENEFIT PLAN.
Summary of Assessment
The provisions of this bill would allow small group and individual health insurance carriers to make some reasonable modifications, as specified in the bill, at the time of renewal of such policies.
Neither current statute nor the bill defines “reasonable modification”. In order to clarify the meaning of “reasonable modification”, the Commissioner of Insurance would promulgate a regulation. The promulgation of this regulation would have a minimal impact on the workload of the Division of Insurance. This increase in the workload could be absorbed by current staff, but may require re-prioritizing existing workload. The provisions of this bill would not impact any health plans of the state, any other agency of the state, or unit of local government. Therefore, this bill is assessed as having no fiscal impact. The bill would become effective upon signature of the Governor.
