TITLE: CONCERNING ACCESS TO JUSTICE FOR VICTIMS OF FAMILY VIOLENCE, AND MAKING AN APPROPRIATION THEREFOR.
Summary of Legislation
The bill creates the Family Violence Justice Fund in the State Treasury and authorizes the State Court Administrator to make grants from the fund to qualifying organizations providing legal services to indigent victims of family violence. Additionally, the bill identifies services for which fund moneys may be used and requires grant applications be submitted to the Judicial Department. The bill also establishes the formula to be applied in distributing funds to qualified organizations.
The bill authorizes the State Court Administrator to accept funds, grants, gifts, or donations on behalf of the state to implement access to justice by victims of family violence. The bill limits the expenditures for indirect costs to 3 percent of the moneys appropriated to the fund in any state fiscal year.
The bill will take effect July 1, 1999; except that this act shall not take effect unless moneys are appropriated for the family violence justice fund created in Section 14-4-108 C.R.S., in the annual appropriations act or in any other act making appropriation for the fiscal year beginning July 1, 1998.

State Revenues
The bill will have a fiscal impact on General Fund revenue from the acceptance of funds, grants, gifts or donations deposited into the Family Violence Justice Fund. The amount generated cannot be estimated, however the moneys received would be used to provide services to indigent victims of family violence.
State Expenditures
The bill will have a fiscal impact on General Fund expenditures from the disbursement of moneys to victims of family violence. Funds will be allocated to qualifiying organizations providing legal services to indigent victims and would come from the Family Violence Justice Fund established in the State Treasury. Additionally, although the amount received from funds, grants, gifts, or donations and moneys appropriated by the General Assembly cannot be determined, not more than three percent of the fund will be used for indirect costs associated with the administration of the fund.
