TITLE:            CONCERNING REQUIREMENTS RELATED TO THE RELATIONSHIP BETWEEN PHYSICIAN PROVIDERS AND CARRIERS PROVIDING COVERAGE THROUGH MANAGED CARE PLANS UNDER THE “CONSUMER PROTECTION STANDARDS ACT FOR THE OPERATION OF MANAGED CARE PLANS”.



Summary of Assessment


            The provisions of this bill would require managed care plans to have a medical director with an active Colorado license to practice medicine. The bill also would prohibit health insurance carriers from entering into a contract with a provider that includes an indemnification or hold harmless clause for the acts or conduct of the carrier or managed care plan. The bill would become effective July 1, 1998.


            The provisions of this bill would have a minimal impact on the workload of the State Board of Medical Examiners. It would not affect the workload, costs, or revenues of the Division of Insurance, the Medicaid program, the employee benefits program, or any other agency or program of the state, or unit of local government. Therefore, this bill is assessed as having no fiscal impact.
