TITLE:            CONCERNING REQUIRING CERTIFICATES OF REVIEW IN PROFESSIONAL NEGLIGENCE ACTIONS TO INCLUDE THE DEFENDANT’S EMPLOYER.



Summary of Assessment


            The provisions of this bill would require the certificate of review filed with the court in a professional negligence action to include any company or firm that employed the acupuncturist or licensed professional at the time of the alleged professional negligence. The bill would become effective February 1, 1999, or on the date of the official declaration of the vote of the people as proclaimed by the Governor, if a referendum petition is filed pursuant to Article V, Section 1 (3) of the State Constitution.


            The bill would affect the plaintiff’s or complainant’s attorney in such action. The bill would not affect any agency of the state or unit of local government. Therefore, this bill is assessed as having no fiscal impact.
