TITLE: CONCERNING DEREGULATION OF PASSENGER TRANSPORTATION, AND, IN CONNECTION THEREWITH, EXEMPTING CAR POOL AND VAN POOL ARRANGEMENTS IN WHICH THE OWNER OR OPERATOR OF A VEHICLE RECEIVES COMPENSATION FROM PASSENGERS.
Summary of Assessment
The bill would clarify that car pool and van pool arrangements are included in the limited exemption to the common carrier and contract carrier regulatory statutes. The bill will become effective at 12:01 a.m. on the day following the ninety-day period after adjournment sine die of the General Assembly, or on the date of the official declaration of the vote of the people as proclaimed by the Governor, if a referendum petition is filed pursuant to Article V, Section 1 (3) of the State Constitution.
The bill would not reduce the number of carriers regulated by the Public Utilities Commission. The bill clarifies that carpools and vanpools in which the owner or operator of a vehicle with a passenger capacity of 16 or less receives compensation from passengers would be exempt from common carrier and contract carrier regulation. The bill would not change existing revenues, expenditures, or workloads for state or local governments. Therefore, this bill is assessed as having no fiscal impact..
