Local Government Impact — The bill identifies the method of apportioning any special school district organization election costs, and requires that members of a school organization planning committee be compensated for actual expenses incurred in the performance of their duties. |
This bill would require the school district boards of education that are affected by the appointment of a school organization planning committee to cooperate with the committee by providing any information requested by the committee to assist in formulating the plan of organization. Current law states that school districts may compensate members of a school organization planning committee for actual expenses incurred in the performance of their duties. The bill would require school districts to compensate committee members for actual expenses incurred.
The bill would prohibit a plan of organization from setting school district boundaries in a way that results in creating any portion of a school district that is not contiguous to the remainder of the school district. The bill also provides that the expense of any special school district organization election shall be apportioned among the affected school districts based on population.
Since the bill would only apply to the actions of any future school organization planning committee that may be established to study the organization of a school district with the goal of developing a plan for reorganization, the bill is assessed as having a conditional school district fiscal impact. The bill will become effective at 12:01 a.m. on the day following the ninety-day period after adjournment sine die of the General Assembly, or on the date of the official declaration of the vote of the people as proclaimed by the Governor, if a referendum petition is filed pursuant to Article V, Section 1 (3) of the State Constitution.
School District Impact
The bill identifies the method of apportioning any special school district organization election costs based on the population of the affected school districts in the most recent federal decennial census. Current law states that the cost of conducting an election shall be paid by the governing body calling the election. The bill also requires that members of a school organization planning committee be compensated for actual expenses incurred in the performance of their duties. Since current law states that the compensation for committee members is optional on the part of school districts, the bill assures reimbursement of expenses incurred.
Spending Authority
The fiscal note would imply that no appropriations or spending authority are required in FY 1998-99 to implement the provisions of the bill.
