TITLE:            CONCERNING CONSOLIDATION OF PROCEDURES FOR ISSUING CIVIL RESTRAINING ORDERS.


Summary of Assessment


            The bill consolidates provisions for the issuance of restraining orders:

 

               to prevent abuse of the elderly;

               to prevent domestic violence;

               in connection with a domestic proceeding; and

               pursuant to rule 365 of the Colorado Rules of County Court Civil Procedure.


            It specifies that the intent of the consolidation is to simplify statutory provisions. The bill further requires the Colorado Supreme Court to adopt rules and mandate uniform forms to implement the act. Any restraining order issued prior to the effective date of the act shall be deemed to be issued in accordance with the provisions of the act. The bill includes an effective date of July 1, 1998, and applies to civil restraining orders issued on or after said date.


            The bill consolidates provisions for the issuance of restraining orders to simplify statutory provisions. The fiscal note assumes that the requirement of uniform forms can be implemented within existing appropriations to the Judicial Department. Therefore, this bill is assessed as having no fiscal impact.
