TITLE:            CONCERNING CLARIFICATION OF PROVISIONS REGARDING UNDERAGE PERSONS DRIVING WITH ALCOHOL CONTENT, AND, IN CONNECTION THEREWITH, CLARIFYING THAT DRIVING A MOTOR VEHICLE WHILE UNDER TWENTY-ONE YEARS OF AGE WHILE HAVING A BLOOD OR BREATH ALCOHOL CONTENT OF AT LEAST 0.02 BUT NOT MORE THAN 0.05 IS A TRAFFIC INFRACTION.



Summary of Assessment


            The bill would include a person under the age of 21 who drives with a blood alcohol level content of exactly 0.05 under the provisions of law that apply to those with a blood alcohol level content of at least 0.02 but less than 0.05. This would equalize the treatment of persons in this group and make the penalties consistent for driving under the influence. The bill would become effective upon the Governor’s signature.


            This bill is assessed as a technical correction to an existing law adopted during the last legislative session. The persons that this bill includes under the law were considered into the fiscal note for HB 97-1307. Therefore, this bill is assessed as having no fiscal impact.
