TITLE:            CONCERNING THE EXTENSION OF THE STATUTORY LIMITATION PERIOD FOR THEFT OF TRADE SECRETS.



Summary of Assessment


            The bill extends the limitation period to three years for the commencement of criminal proceedings in cases of theft of trade secrets. Additionally, it tolls the beginning of the limitation period until discovery of the theft, which is current practice for certain other offenses involving fraud or concealment. The bill is effective July 1, 1998, and applies to offenses committed on or after said date.


            The bill changes only the statutory time period allowed for filing. It is not anticipated to increase workload in the courts. Therefore, the bill is assessed as having no fiscal impact.
