TITLE: CONCERNING THE AUTHORITY OF THE AIR QUALITY CONTROL COMMISSION TO REVISE CONTROL REGULATIONS TO UTILIZE NEW OR IMPROVED TECHNOLOGY.
Summary of Legislation
The reengrossed bill, as amended by the Senate Health, Environment, Welfare, and Institutions Committee, February 26, 1998, would allow the owner or operator of any stationary or mobile pollution source to request that the Air Quality Control Commission revise the State Implementation Plan (SIP) or any regulation or standard that is not part of the SIP if the commission determines that compliance with applicable emission control regulations through new or improved technology is economically and technologically feasible. It also allows the department to contract with the Colorado School of Mines for high altitude engine research. The bill would become effective at 12:01 a.m. on the day following the ninety-day period after adjournment sine die of the General Assembly, or on the date of the official declaration of the vote of the people as proclaimed by the Governor, if a referendum petition is filed pursuant to Article V, Section 1 (3) of the State Constitution.

The bill would clarify that the Air Quality Control Division consider new or improved technology that is economically and technologically feasible be in the state implementation plan and regulations and standards. These provisions of the bill would not change existing revenues, expenditures, or workloads for state or local governments.
The Senate Health, Environment, Welfare, and Institutions Committee amendment would allow the department to contract with the Colorado School of Mines Institute for Fuels and High Altitude Engine Research to test heavy duty vehicles. The amendment appropirates $150,000 in AIR Account funds to the department for this purpose.
Spending Authority
This fiscal note implies that the Departmet of Public Health and Environment would require $150,000 in AIR Account spending authority for FY 1997-98 to implement this bill.
