TITLE:            CONCERNING ENFORCEMENT OF THE COLORADO INSTANT CRIMINAL BACKGROUND CHECK SYSTEM, AND, IN CONNECTION THEREWITH, CHANGING THE REPEAL DATE TO COINCIDE WITH FEDERAL LAW AND CLARIFYING CERTAIN PROVISIONS WITHIN THE COLORADO INSTANT CRIMINAL BACKGROUND CHECK SYSTEM.



Summary of Legislation


            The reengrossed bill changes the repeal date for the “Instant Criminal Background Check System Act” to coincide with implementation of the National Instant Criminal Background Check System by the Federal Government. Further, the bill instructs the Colorado Bureau of Investigation to notify the Revisor of Statutes, Office of Legislative Legal Services, when the national system becomes operational and specifies the repeal date to be when the revisor is notified.


            The bill will be effective upon signature of the Governor.


            The reengrossed bill simply allows the Colorado Bureau of Investigation (CBI) to continue the “Instant Criminal Background Check System”after November 30, 1998 and until the date the national background check program is implemented. There would be no fiscal impact to the CBI, therefore, the reengrossed bill is assessed as having no fiscal impat on state revenue or expenditures.
