A BILL FOR AN ACT

CONCERNING THE ELIMINATION OF FUNDING FOR COUNTY COURTHOUSE FURNISHINGS.

Eliminates the responsibility of the state to appropriate moneys for county courthouse furnishings and directs that expenses for county courthouse furnishings shall be the responsibility of the board of county commissioners of each county.

Adjusts the long bill appropriation to the judicial department to implement this act.


Be it enacted by the General Assembly of the State of Colorado:

SECTION 1.  13­3­104 (1), Colorado Revised Statutes, 1987 Repl. Vol., is amended to read:

13­3­104.  State shall fund courts. (1)  On and after January 1, 1970, the state of Colorado shall provide funds by annual appropriation for the operations, salaries, and other expenses of all courts of record within the state, except for county courts in the city and county of Denver and municipal courts. ON AND AFTER JULY 1, 1997, THE STATE OF COLORADO SHALL NOT BE RESPONSIBLE FOR THE ACQUISITION OF FURNITURE OR OTHER FURNISHINGS OF COURTS OF RECORD WITHIN THE STATE, AND EXPENSES FOR SUCH ITEMS SHALL BE THE RESPONSIBILITY OF THE BOARD OF COUNTY COMMISSIONERS IN EACH COUNTY. On January 1, 1970, all supplies and equipment assigned or belonging to courts of record, except motor vehicles, shall be transferred to and become the property of the judicial department of the state. Such transfer of supplies and equipment shall not apply to the county court of the city and county of Denver or to municipal courts.

SECTION 2.  Appropriation in long bill to be adjusted. For the implementation of this act, the appropriation made in the annual general appropriation act for the fiscal year beginning July 1, 1997, shall be adjusted as follows: The general fund appropriation to the judicial department, courts administration, administration, for county courthouse furnishings is decreased by nine hundred twenty thousand six hundred thirty­two dollars ($920,632).

SECTION 3.  Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
