A BILL FOR AN ACT

CONCERNING AN INCREASE IN THE ALLOWABLE FEES CHARGED BY THE DEPARTMENT OF AGRICULTURE FOR METROLOGY CERTIFICATION.

Eliminates the existing cap of $20 per hour for laboratory services performed by the department of agriculture for metrology certification. Directs the commissioner of agriculture to set the fees for such services annually at a rate designed to recover actual costs.


Be it enacted by the General Assembly of the State of Colorado:

SECTION 1.  35­14­128 (2), Colorado Revised Statutes, 1995 Repl. Vol., is amended to read:

35­14­128.  Laboratory approval ­ service ­ condemnation. (2)  The laboratory may require that specified standards submitted for calibration be cleaned or sanded, scraped, and painted before submission. Precision weights, volume, and length standards shall be cleaned and dried before submission. The fee for any metrology service shall not exceed twenty dollars per hour. The commissioner shall set the fee FOR METROLOGY SERVICES annually at a rate not to exceed DESIGNED TO RECOVER actual costs. When metrology services are to be performed outside the laboratory, the laboratory shall be reimbursed for travel and time at the same rates for special tests set forth in section 35­14­127 (12).

SECTION 2.  Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
