HOUSE BILL 97­1245

CONCERNING THE AUTHORITY TO CHARGE AGAINST THE UNEMPLOYMENT COMPENSATION FUND FOR BENEFITS AWARDED TO A CLAIMANT WHO HAS SEPARATED FROM EMPLOYMENT DUE TO AN ADDICTION TO ALCOHOL OR CONTROLLED SUBSTANCES.

Be it enacted by the General Assembly of the State of Colorado:

SECTION 1.  8­73­108 (4) (b), Colorado Revised Statutes, 1986 Repl. Vol., as amended, is amended BY THE ADDITION OF A NEW SUBPARAGRAPH to read:

8­73­108.  Benefit awards. (4) (b) (IV.5)  ANY BENEFITS AWARDED TO THE CLAIMANT UNDER THE PROVISIONS OF SUBPARAGRAPH (IV) OF THIS PARAGRAPH (b) AND NORMALLY CHARGEABLE TO THE EMPLOYER WILL BE CHARGED TO THE FUND.

SECTION 2.  Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
